The Service includes software applications, data processing tools, analytics dashboards, and related support services. Env does not guarantee specific environmental outcomes or regulatory compliance results, as these depend on user-provided data and operational implementations.

3. User Accounts & Security

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities occurring under your account. You agree to:

• Provide accurate, current, and complete information during registration.
• Notify Env immediately of any unauthorized use or security breach.
• Ensure that all personnel using the Service on your behalf comply with these Terms.

4. Data & Privacy

Your use of the Service is also governed by Env's Privacy Policy, which is incorporated herein by reference. Env collects and processes environmental data, usage metrics, and account information solely to provide, improve, and secure the Service. We implement industry-standard security measures to protect your data but cannot guarantee absolute security of information transmitted over the internet.

5. Intellectual Property

The Service, including its underlying technology, software, design, content, and intellectual property rights, is owned by Env and protected by copyright, trademark, and other applicable laws. 7. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. Env shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid to Env in the twelve months preceding the claim.

8. Termination

Env may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. You may export your data for a period of 30 days following termination. Sections regarding disclaimers, liability, intellectual property, and governing law shall survive termination.

9. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, unless otherwise required by law.

10. Changes to Terms

Env reserves the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification at least 30 days prior to the effective date. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
