International Traffic in Arms Regulations (ITAR) 22 CFR Chapter XII

ITAR is a set of United States government regulations that controls the design and manufacture of military equipment and the control of data relating to such items. At AeroVance, ITAR compliance is paramount for our defense contracts and dual-use technologies.

  • Governed by the U.S. Department of State, Directorate of Defense Trade Controls (DDTC).
  • Covers defense articles and defense services listed on the United States Munitions List (USML).
  • Requires registration with DDTC and strict authorization for export, re-export, or deemed exports.
  • Violations carry severe civil and criminal penalties, including imprisonment and debarment.

Export Administration Regulations (EAR) 15 CFR Parts 730-774

The EAR is a set of regulations that govern the temporary export and reexport of commercial, defense, and dual-use items. AeroVance adheres to EAR requirements to ensure commercial aerospace technologies are distributed in accordance with U.S. national security and foreign policy goals.

  • Governed by the U.S. Department of Commerce, Bureau of Industry and Security (BIS).
  • Covers items listed on the Commerce Control List (CCL) and items eligible for the EAR99 category.
  • Requires determination of Export Control Classification Number (ECCN) for all relevant products.
  • Prohibits exports to denied parties, embargoed countries, and restricted end-uses without proper licensing.

Employee Responsibilities & Guidelines

Restricted Technical Data (RTD)

Do not share, email, or transmit Restricted Technical Data to any non-U.S. person without explicit written approval from the Export Control Officer. This includes foreign nationals physically present in the U.S. (Deemed Export).

Need-to-Know Basis

Access to controlled information is granted on a strict need-to-know basis. Limit access to sensitive documentation and technical files to authorized personnel only.

End-Use Verification

Verify the final destination and end-use of all products and data. Report any suspicious activities, unusual requests, or deviations from authorized use cases immediately.

Deemed Exports

Providing technical data to a foreign national in the U.S. is considered a "deemed export" under U.S. law. Always check nationality status before sharing ITAR/EAR controlled information.
