1. Governing Law
All disputes, claims, or causes of action arising out of or relating to the interpretation, validity, performance, or breach of these Terms of Service, including any non-contractual disputes or claims, shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles.
This choice of law applies regardless of where you reside or where any dispute originates. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.
2. Dispute Resolution Process
Aevum News is committed to resolving disputes efficiently, fairly, and transparently. We encourage direct communication and have established a tiered resolution process to address concerns before they escalate to formal proceedings.
The following steps outline the mandatory procedures for dispute resolution:
1 Informal Negotiation
Before initiating any formal dispute resolution process, you must notify Aevum News in writing of the nature and basis of your claim or dispute, and the specific relief sought. Notifications should be sent to our designated legal contact (see Section 7). Aevum News will acknowledge receipt within five (5) business days and will endeavor to resolve the dispute informally within thirty (30) days of receipt of your notice.
- Provide a detailed description of the dispute
- Include relevant account information or transaction IDs
- Specify the desired resolution or compensation
- Allow the 30-day resolution window to expire before proceeding
2 Mediation
If the dispute cannot be resolved informally within the 30-day period, either party may request mediation. Mediation shall be conducted by a mutually agreed-upon neutral mediator selected from a recognized professional mediation organization, such as the American Arbitration Association (AAA) or JAMS.
Mediation shall take place virtually or in the State of New York. Costs of mediation shall be shared equally between the parties, unless otherwise agreed. Nothing stated or disclosed during mediation shall be admissible in any subsequent arbitration or court proceeding.
3 Binding Arbitration
If mediation is unsuccessful, any unresolved dispute, claim, or controversy shall be finally settled by binding arbitration administered by the AAA in accordance with its Commercial Arbitration Rules. The arbitration shall be conducted by a single arbitrator and shall take place in New York County, New York, or at a mutually agreed alternative location.
Aevum News shall bear all arbitration costs for claims under $10,000 USD. For claims exceeding this amount, costs shall be allocated according to the applicable arbitration rules. The arbitrator's decision shall be final, binding, and enforceable in any court of competent jurisdiction.
3. Class Action & Jury Trial Waiver
By using Aevum News, you explicitly agree that any dispute resolution conducted pursuant to these Terms shall be conducted solely on an individual basis. You waive any right to bring a claim in a class action, consolidated action, private attorney general action, or representative proceeding against Aevum News or its affiliates, officers, directors, employees, agents, predecessors, successors, or assigns.
Furthermore, you and Aevum News hereby waive any right to a trial by jury. You acknowledge that this waiver is knowing, voluntary, and intended to be binding on all parties.
