1. Scope & Acceptance
By accessing, using, or transacting through any platform, interface, subsidiary, or service operated by Aevum Zenth Conglomerate (collectively, the "Conglomerate"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you ("User" or "Client") and Aevum Zenth Conglomerate.
If you are entering into this agreement on behalf of an organization, you represent that you have the authority to bind that entity to these Terms. If you do not accept these Terms in their entirety, you must discontinue use of all Conglomerate services immediately.
2. Definitions & Interpretations
- "Services" refers to all software, hardware, consulting, infrastructure, financial, energy, aerospace, healthcare, media, and logistical offerings provided across the Conglomerate’s 400+ subsidiaries.
- "Division" denotes any operational vertical within Aevum Zenth (e.g., Aevum Energy, Zenth Digital, Aevum Capital Group).
- "Personal Data" has the meaning assigned under applicable data protection regulations, including but not limited to GDPR, CCPA, and the Global Data Sovereignty Act.
3. Cross-Divisional Services
Aevum Zenth operates an integrated ecosystem where data, credentials, and service access may flow across Divisions to enhance efficiency and innovation. By using one Division’s services, you consent to the sharing of necessary operational data with other Divisions strictly for service fulfillment, compliance, security, and product improvement purposes.
Cross-divisional data transfer is governed by our Data Interoperability Framework v2.8 and adheres to zero-trust architecture standards. You may request a divisional data map via your compliance portal.
4. Data Processing & Privacy
The Conglomerate processes user data in accordance with the Aevum Zenth Privacy Policy. We employ encryption, tokenization, and regional data residency controls to safeguard information. You retain rights to access, correct, export, or request deletion of your data, subject to legal retention obligations and contractual service dependencies.
Automated decision-making systems, including AI-driven risk assessment and service personalization, operate under human-supervised protocols. You may opt out of algorithmic profiling by contacting our Data Governance Office.
5. User Obligations & Conduct
You agree to use the Services solely for lawful purposes and in compliance with all applicable local, national, and international laws. Prohibited conduct includes, but is not limited to:
- Reverse-engineering, decompiling, or extracting proprietary code, models, or infrastructure configurations.
- Using automated scraping, credential stuffing, or DDoS attacks against Conglomerate systems.
- Facilitating fraud, money laundering, export control violations, or sanctioned entity transactions.
- Reselling or redistributing licensed enterprise services without explicit written authorization.
The Conglomerate reserves the right to suspend, terminate, or restrict access to Services for violations of this section without prior notice.
6. Intellectual Property
All content, trademarks, patents, source code, design patents, research outputs, and proprietary methodologies developed by or licensed to Aevum Zenth remain the exclusive property of the Conglomerate. These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for their intended purpose.
User-generated content submitted to Conglomerate platforms may be used for service improvement, analytics, and marketing, subject to applicable privacy consent. Commercial IP derived from joint development projects is governed by separate Master Service Agreements (MSAs).
7. Limitation of Liability
To the maximum extent permitted by law, Aevum Zenth Conglomerate and its subsidiaries, officers, directors, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Services.
The Conglomerate’s total aggregate liability shall not exceed the total fees paid by you for the specific service in question during the twelve (12) months preceding the claim. Certain jurisdictions do not allow exclusions of implied warranties or limitation of liability; in such cases, liability is limited to the fullest extent permitted.
8. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles. International clients subject to mandatory local jurisdiction clauses shall have those terms honored where legally required.
Any dispute arising from or related to these Terms shall first be submitted to mandatory mediation. If unresolved within sixty (60) days, disputes shall be settled by binding arbitration under the rules of the International Chamber of Commerce (ICC). Class action waivers and jury trial waivers apply, except where prohibited by consumer protection statutes.
9. Amendments & Archive Policy
Aevum Zenth reserves the right to modify these Terms at any time. Material changes will be communicated via email, dashboard notification, or service-level agreement update. Continued use following notification constitutes acceptance of the revised Terms.
All superseded versions are preserved in our legal archive for compliance and historical reference. Access to archived terms does not constitute reliance on obsolete contractual obligations.
