Terms of Service, Privacy & Compliance Framework

1.1 Acceptance of Terms

By accessing, interacting with, or utilizing any Aevum Zenth Conglomerate platform, API, subsidiary service, or digital interface, you acknowledge and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease use and disconnect from all Aevum Zenth systems.

1.2 Scope of License

Aevum Zenth grants you a limited, non-exclusive, non-transferable, revocable license to use its digital services strictly for lawful, personal, or authorized commercial purposes. Reverse engineering, decompilation, scraping, or unauthorized API usage is strictly prohibited and will result in immediate termination of access and potential legal action.

1.3 User Conduct & Prohibited Activities

• Attempting to circumvent security controls, rate limits, or authentication mechanisms
• Uploading malware, exploit code, or engaging in DDoS activities
• Using Aevum Zenth infrastructure for unauthorized data mining or AI training without explicit written consent
• Impersonating Aevum Zenth personnel, systems, or affiliated entities

1.4 Service Modifications & Termination

Aevum Zenth reserves the right to modify, suspend, or discontinue any service without prior notice. Violations of these Terms may result in immediate account termination, IP blacklisting, and preservation of forensic logs for law enforcement cooperation.

2.1 Data Collection Principles

Aevum Zenth adheres to the principle of data minimization. We only collect, process, and retain data strictly necessary for service delivery, regulatory compliance, and security monitoring. No biometric or sensitive personal data is processed without explicit, documented consent.

2.2 Data Processing & Third-Party Transfers

All data transfers outside the originating jurisdiction are governed by Standard Contractual Clauses (SCCs) and/or Binding Corporate Rules (BCRs). Third-party vendors undergo annual SOC 2 Type II audits and must comply with Aevum Zenth’s Zero Trust Data Handling Policy.

2.3 User Rights & Data Subject Requests

Users retain the right to access, rectify, erase, restrict, or port their data. Requests are processed within 30 calendar days. A dedicated Data Protection Officer (DPO) oversees all compliance activities and can be reached at dpo@aevumzenth.com.

3.1 Infrastructure Security

Aevum Zenth operates a Zero Trust Architecture across all 400 subsidiaries. All network segments are micro-segmented, and access requires multi-factor authentication (MFA), hardware-backed keys, or conditional access policies based on device posture and geolocation.

3.2 Encryption & Key Management

• In-Transit: TLS 1.3 with AEAD ciphers, HSTS enforced, certificate pinning on critical APIs
• At-Rest: AES-256-GCM with customer-managed keys (CMK) available for enterprise tiers
• Key Management: FIPS 140-3 Level 3 validated HSMs, automated key rotation every 90 days

3.3 Incident Response & Disclosure

Security incidents are classified by severity (SEV1-SEV4). SEV1 breaches involving PII/PHI trigger mandatory regulatory notification within 72 hours per GDPR Article 33. Public disclosure follows via the Aevum Zenth Transparency Report portal.

4.1 Industry-Specific Compliance

Aevum Zenth maintains active compliance certifications across all operational divisions:

• Healthcare: HIPAA, HITECH, EU MDR, FDA 21 CFR Part 11
• Finance: PCI-DSS Level 1, SOX, MiFID II, MAS TRM, Basel III
• Aerospace/Defense: ITAR, EAR, NIST SP 800-171, CMMC Level 3

4.2 Anti-Corruption & Sanctions

All transactions and partnerships are screened against OFAC, EU, UK HMT, and UN sanctions lists. Aevum Zenth enforces a strict zero-tolerance policy regarding bribery, kickbacks, and facilitation payments in accordance with the FCPA and UK Bribery Act 2010.

5.1 Ownership of Assets

All Aevum Zenth software, trademarks, patents, trade secrets, documentation, and proprietary algorithms remain the exclusive property of Aevum Zenth Conglomerate and its affiliated entities. No rights are granted except as explicitly stated in this document.

5.2 Open Source & Third-Party Components

Where applicable, third-party open-source components are used in strict compliance with their respective licenses (MIT, Apache 2.0, GPL, etc.). A complete Software Bill of Materials (SBOM) is available to enterprise clients upon request.

5.3 Infringement Reporting

Unauthorized use, reproduction, or distribution of Aevum Zenth IP will be pursued under applicable copyright and patent laws. Reports should be submitted to legal-ip@aevumzenth.com with verifiable evidence.

6.1 Limitation of Liability

To the maximum extent permitted by law, Aevum Zenth shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business interruption, arising from the use or inability to use its services.

6.2 Governing Law & Jurisdiction

These Terms are governed by the laws of the Swiss Confederation, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Geneva, Switzerland, under ICC Rules. Class action waivers apply where legally enforceable.

6.3 Force Majeure

Aevum Zenth is not liable for failures or delays caused by events beyond reasonable control, including natural disasters, cyberattacks, government actions, or critical infrastructure failures.
