Welcome to GeoServer. These Terms of Service ("Terms") govern your access to and use of the GeoServer platform, including our cloud-based geospatial infrastructure, mapping tools, APIs, documentation, and related services (collectively, the "Service").
By registering for an account, accessing the Service, or clicking "I Agree," you acknowledge that you have read, understood, and agree to be legally bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.
2. Definitions
- "Service" refers to the GeoServer platform, including software, APIs, hosting infrastructure, and related tools.
- "User" or "You" refers to the individual or organization accessing the Service.
- "Content" refers to any data, maps, layers, metadata, or files uploaded, processed, or generated through the Service.
- "GeoServer" refers to the operating company providing the Service.
3. Accounts & Security
To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You agree to:
- Provide accurate, current, and complete registration information.
- Notify us immediately of any unauthorized use or security breach.
- Comply with all applicable laws regarding data handling and cybersecurity.
GeoServer reserves the right to suspend or terminate accounts that violate these Terms or exhibit suspicious activity.
4. Permitted Use & Restrictions
You may use the Service for lawful geospatial data processing, mapping, analytics, and integration with your applications. You agree not to:
- Use the Service to distribute malware, spam, or malicious code.
- Attempt to reverse-engineer, decompile, or extract underlying source code.
- Resell, sublicense, or redistribute the Service without explicit written authorization.
- Exceed fair usage limits or deploy automated scraping/bot attacks against our APIs.
- Upload illegal, infringing, or classified government-restricted geospatial data.
5. Intellectual Property
All intellectual property rights in the Service, including software, design, trademarks, documentation, and proprietary algorithms, remain the exclusive property of GeoServer and its licensors.
Retaining ownership of your uploaded Content is yours. By uploading Content, you grant GeoServer a limited, revocable license to host, process, and render your data solely for the purpose of providing the Service. You warrant that you have all necessary rights to upload and process such Content.
6. Data & Privacy
Your privacy is important to us. Our handling of personal data and geospatial metadata is governed by our Privacy Policy, which is incorporated into these Terms by reference. We implement industry-standard encryption, access controls, and data isolation practices to protect your information.
You remain responsible for ensuring that your Content and data-sharing practices comply with applicable data protection regulations, including GDPR, CCPA, and sector-specific geospatial compliance requirements.
7. Service Availability & Support
GeoServer strives to maintain 99.9% uptime for paid tiers, as outlined in our Service Level Agreement (SLA). However, we do not guarantee uninterrupted, error-free, or instantaneous service due to factors beyond our control, including maintenance, third-party provider outages, or force majeure events.
Support response times and channels depend on your subscription tier. Free-tier users receive community support, while paid tiers receive prioritized technical assistance.
8. Limitation of Liability
To the maximum extent permitted by applicable law, GeoServer and its affiliates, directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunity, or geospatial analysis outcomes arising from your use or inability to use the Service.
Our total aggregate liability shall not exceed the amount you paid us during the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify, defend, and hold harmless GeoServer and its related parties from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:
- Your violation of these Terms or applicable laws.
- Your Content infringing on third-party intellectual property or privacy rights.
- Unauthorized access to or misuse of your account credentials.
10. Termination
Either party may terminate this agreement under the conditions outlined below:
- By You: You may close your account at any time through your dashboard settings.
- By GeoServer: We may suspend or terminate your access immediately for material breach, non-payment, or illegal activity.
Upon termination, your access to the Service will cease, and any unused prepaid credits may be forfeited. We will provide a 30-day window for data export before permanent deletion, unless earlier removal is required by law.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA), conducted on an individual basis in Wilmington, Delaware.
Class action waivers and jury trial waivers apply to the extent permitted by law.
12. Modifications
GeoServer reserves the right to modify, update, or replace these Terms at any time. Material changes will be communicated via email or prominent notices on the platform. Your continued use of the Service after such changes constitutes acceptance of the revised Terms.
