Section 7.4: Third-Party Actions & Tenant Conduct

7.4.1 Scope & Purpose
This section establishes the standards governing tenant behavior, guest management, and third-party interactions within all HomeNest-managed properties. The purpose is to ensure a safe, respectful, and legally compliant living environment for all residents, guests, and neighboring properties.
This policy supplements the Master Lease Agreement and Residential Property Guidelines. In the event of a conflict, the executed Lease Agreement shall take precedence. Tenants are expected to review and acknowledge these terms upon move-in.
7.4.2 Third-Party Guests & Visitors
HomeNest recognizes the right of tenants to receive guests, provided such visits do not disrupt the community or violate property rules.
- Duration Limits: Guests may stay overnight for a maximum of 7 consecutive days or 14 days within a 30-day period. Beyond this threshold, the individual may be classified as an unauthorized occupant.
- Liability: The primary tenant is fully responsible for the actions, damages, and compliance of all guests while on the premises.
- Common Areas: Guests must be accompanied by the host tenant in shared spaces and must adhere to all quiet hours and facility regulations.
- Short-Term Subletting: Short-term rentals (Airbnb, VRBO, etc.) are strictly prohibited unless explicitly authorized in writing by HomeNest and compliant with local zoning ordinances.
Consistent guest presence exceeding stated limits without prior written approval will be treated as a lease violation and may result in notice to vacate or removal proceedings per local landlord-tenant law.
7.4.3 Tenant Conduct Standards
All residents are expected to maintain a respectful and lawful environment. The following conduct standards apply to all units and property grounds:

7.4.4 Contractors & Service Providers
Third-party vendors entering the property for tenant-requested services must comply with the following:
- Advance Notice: HomeNest must be notified at least 24 hours before any contractor access, especially for exterior or shared infrastructure work.
- Insurance & Licensing: Contractors performing structural, electrical, plumbing, or roofing work must provide proof of valid licensing and liability insurance upon request.
- Work Hours: Service work is permitted between 8:00 AM and 6:00 PM, Monday–Friday, unless emergency repairs are authorized by management.
- Property Protection: Contractors must cover flooring, clean work areas, and dispose of debris in designated zones. Damage caused by third parties will be billed to the responsible tenant.
7.4.5 Violations & Enforcement
Failure to comply with Section 7.4 may result in the following progressive enforcement measures:
- First Offense: Written warning and mandatory acknowledgment of policy.
- Second Offense: Formal notice of violation, potential fine (where legally permitted), and required remediation plan.
- Third Offense / Severe Violations: Lease termination proceedings, legal action for damages, and reporting to relevant tenant screening databases.
Where applicable by state law, HomeNest will provide a reasonable opportunity to cure minor violations before initiating termination proceedings. Emergency safety or legal violations may be addressed immediately.
7.4.6 Reporting & Compliance
Tenants are encouraged to report conduct violations, safety hazards, or unauthorized third-party activity promptly. All reports are handled confidentially and investigated within 48 hours.

Retaliation against tenants who report violations in good faith is strictly prohibited and will result in disciplinary action against the retaliating party.
By signing the Lease Agreement and/or the Resident Handbook Acknowledgment Form, tenants confirm they have read, understood, and agree to abide by Section 7.4: Third-Party Actions & Tenant Conduct. Copies are available in the Tenant Portal under Documents & Policies.
