HomeNest Property Management Services operates under a strict legal and regulatory compliance framework. This document outlines our adherence to federal, state, and municipal laws governing residential and commercial property management, tenant relations, data handling, and dispute resolution.
1. Overview & Scope
This compliance framework applies to all HomeNest operations, including property owners, tenants, maintenance contractors, and third-party service providers. Our legal obligations are governed by contract law, housing regulations, consumer protection statutes, and data privacy legislation.
Commitment Statement
HomeNest is committed to transparent, lawful, and ethical property management practices. All staff undergo mandatory legal compliance training and are required to report regulatory concerns through our internal oversight channel.
2. Fair Housing & Anti-Discrimination
HomeNest strictly complies with the federal Fair Housing Act (FHA), along with state and local anti-discrimination ordinances. We prohibit discrimination in housing-related transactions based on:
- Race, color, or national origin
- Religion or familial status
- Sex, sexual orientation, or gender identity
- Disability or handicap
- Source of income (including government assistance)
All marketing materials, tenant screening criteria, and lease negotiations are conducted without regard to protected characteristics. Reasonable accommodations for disabilities are evaluated and implemented on a case-by-case basis in accordance with HUD guidelines.
3. Data Privacy & Security
HomeNest processes sensitive personal and financial data in compliance with applicable privacy laws, including the California Consumer Privacy Act (CCPA), where applicable, and industry security standards.
- Data Collection: We only collect information necessary for tenant screening, lease administration, and payment processing.
- Storage & Encryption: All data is encrypted in transit (TLS 1.3) and at rest (AES-256). Access is restricted to authorized personnel via multi-factor authentication.
- Third-Party Sharing: Data is not sold or rented. Sharing with credit bureaus or background check services occurs only with explicit written consent.
- Data Retention: Records are retained for a maximum of 7 years post-lease termination, or as required by state law, whichever is longer.
4. Tenant Screening Standards
Screening procedures comply with the Fair Credit Reporting Act (FCRA) and state-specific landlord-tenant statutes. Our standardized evaluation includes:

Adverse Action Notice
In the event of denial based on screening results, HomeNest will issue a standardized adverse action notice including the name of the reporting agency and the applicant's right to dispute inaccuracies, as required by federal law.
5. Rental Agreement Compliance
All lease agreements drafted or managed by HomeNest comply with state residential tenancy codes and include mandatory disclosures. Standard clauses address:
- Rent amount, due dates, and accepted payment methods
- Late fee structures (capped per state limits)
- Security deposit handling & refund timelines
- Utility responsibilities & tenant alterations
- Right of entry & inspection notice periods
- Termination conditions & early exit provisions
Electronic signatures are processed via DocuSign or equivalent platforms, maintaining compliance with the ESIGN Act and UETA. Paper copies remain available upon request.
6. Local & State Regulatory Compliance
HomeNest maintains active registration with municipal licensing boards where required. We monitor and implement updates to:
- Rental housing registration & inspection programs
- Short-term rental ordinances (where applicable)
- Lead-based paint disclosure requirements (pre-1978 properties)
- Mold, pest, and habitability standards
- Eviction moratoriums & emergency housing orders
Compliance audits are conducted quarterly. Any regulatory changes are disseminated to management staff within 5 business days of effective date.
7. Dispute Resolution & Arbitration
HomeNest encourages mediation as the primary method for resolving conflicts between owners and tenants. Our escalation framework includes:
- Internal Review: Written complaint submitted to the assigned property manager within 14 days of incident.
- Mediation: Voluntary, cost-shared mediation with a neutral third party certified by the American Arbitration Association.
- Binding Arbitration: Reserved for claims under $50,000, conducted per AAA Commercial Rules. Waiver of class-action participation is not required.
- Judicial Proceedings: Available for matters exceeding arbitration thresholds or involving statutory violations.
8. Insurance & Liability Framework
HomeNest maintains comprehensive coverage to protect owners, tenants, and our operations:
- Professional Liability (E&O): $2M per claim, $5M aggregate
- General Liability: $2M per occurrence
- Cyber Liability: $1M for data breach response & notification
- Umbrella Policy: Additional $5M excess coverage
Property owners are required to maintain hazard and liability insurance naming HomeNest as additional insured. Tenants are advised to secure renter's insurance, though HomeNest does not assume liability for personal property or accidental injuries unrelated to negligence.
9. Amendments & Effective Dates
This document is subject to revision as laws and operational standards evolve. Amendments will be published on this page with updated effective dates. Material changes affecting tenant rights or data handling will be communicated directly via email and property portal notifications at least 30 days prior to implementation.
Previous versions are archived for regulatory reference. In the event of a conflict between this framework and a binding court order or statute, the statute or order shall prevail.
