- No Diagnosis: In Therapy does not provide medical diagnosis, treatment, or prescription services unless explicitly provided by a licensed medical professional within a defined scope of practice.
- Therapy Outcomes: Therapeutic outcomes vary by individual. While our licensed therapists provide evidence-based care, we do not guarantee specific results, cures, or resolutions of mental health conditions.
- Professional Consultation: Always seek the advice of a qualified health provider with any questions regarding a medical or mental health condition. Do not disregard professional medical advice or delay seeking treatment based on information obtained from our platform.
3. Emergency Situations
In Therapy is not equipped to handle emergency situations. Our services are designed for ongoing mental health support and are not intended for crisis intervention.

- In Therapy shall not be held liable for any failure to respond to emergency situations or for any harm resulting from the use of our services in a crisis context.
4. Limitation of Liability
To the fullest extent permitted by applicable law, In Therapy and its affiliates, officers, directors, employees, agents, and therapists shall not be liable for any:
- Indirect, Incidental, Special, Consequential, or Punitive Damages: Including but not limited to loss of profits, data, use, goodwill, or other intangible losses.
- Personal Injury or Property Damage: Arising from or related to your use of our services, website, or platform.
- Third-Party Actions: Any actions, omissions, or content provided by third parties, including guest therapists, external links, or integrated services.
- Technical Issues: Interruptions, delays, errors, or failures in transmission related to telehealth sessions, including but not limited to internet connectivity issues, software glitches, or hardware malfunctions.
- Unforeseen Outcomes: Any psychological, emotional, or physical effects resulting from therapeutic interventions, to the extent such liability is not prohibited by law.
In no event shall the aggregate liability of In Therapy exceed the amount paid by you to In Therapy for the specific service giving rise to the claim, or $100 USD, whichever is greater.
5. Assumption of Risk
By using In Therapy's services, you acknowledge and agree that:
- Therapy and mental health support involve inherent risks, including emotional discomfort, the possibility of regression, and no guarantee of improvement.
- You are responsible for disclosing relevant medical history, medications, and conditions to your therapist to ensure safe and appropriate care.
- You assume all risks associated with the use of our services, including online therapy, digital tools, and self-help resources.
6. Telehealth and Technology Disclaimer
Our online therapy services rely on digital communication technologies. While we use encrypted, HIPAA-compliant platforms, we cannot guarantee absolute security or uninterrupted service.
- You are responsible for ensuring you have a stable internet connection, a private environment, and appropriate devices for your sessions.
- In Therapy is not liable for session disruptions caused by technical failures beyond our control, including but not limited to power outages, ISP issues, or device malfunctions.
- In the event of a technical failure, we will make reasonable efforts to reschedule or compensate for missed sessions in accordance with our booking policy, but such compensation does not constitute an admission of liability.
7. Indemnification
You agree to indemnify, defend, and hold harmless In Therapy and its affiliates, officers, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of:
- Your use of our services or website.
- Your violation of these Terms of Service.
- Your infringement of any third-party rights.
- Your failure to disclose material health information to your therapist.
8. Mandatory Arbitration and Class Action Waiver
Any dispute arising out of or related to these Terms of Service or the use of In Therapy's services shall be resolved through binding arbitration, rather than in court, on an individual basis. You waive your right to participate in a class action lawsuit or class-wide arbitration.
Arbitration will be conducted in accordance with the rules of the American Arbitration Association (AAA) in the jurisdiction where you reside.
9. Governing Law
This Limitation of Liability and the Terms of Service shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law principles.
