1 Voluntary Participation
By accessing the IronForge Fitness facilities ("Facility"), using equipment, attending classes, or receiving services from IronForge Fitness ("Company"), I voluntarily agree to participate in physical fitness activities that involve inherent risks. I am doing so of my own free will and am not compelled to participate.
2 Acknowledgement of Risks
I understand that participation in fitness activities, including but not limited to weightlifting, cardiovascular exercise, group fitness classes, yoga, boxing, martial arts, and use of athletic equipment, carries inherent risks of injury, physical harm, and even death. These risks include, but are not limited to:
- Fractures, sprains, strains, and other musculoskeletal injuries.
- Cardiovascular events, including heart attack or stroke.
- Injuries caused by the equipment, including malfunction or failure.
- Injuries caused by other participants or trainers.
- Injuries resulting from environmental conditions (e.g., heat, slippery surfaces).
- Aggravation of pre-existing medical conditions.
I acknowledge that these risks are inherent to the activities and that despite safety measures, injuries can and do occur.
3 Assumption of Risk
I hereby ASSUME FULL RESPONSIBILITY for any and all risks, hazards, and dangers that may be encountered while participating in activities at the Facility. I voluntarily assume all risks associated with my participation, including risks caused by the negligence of the Company, its agents, employees, trainers, and other members.
4 Release and Waiver of Liability
In consideration of being permitted to participate in activities at IronForge Fitness, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE IronForge Fitness, its owners, officers, directors, employees, agents, trainers, and affiliates (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in activities at the Facility, whether caused by the negligence of the Released Parties or otherwise.
5 Indemnification
I agree to INDEMNIFY AND HOLD HARMLESS the Released Parties from any and all claims, losses, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to my participation in activities at the Facility, my negligence, or my violation of these terms.
6 Medical Certification
I certify that I am in good physical health and have no medical condition that would prevent me from safely participating in fitness activities. I understand that I am responsible for consulting a physician before beginning any exercise program, especially if I have a pre-existing condition or have not exercised recently. If I suffer an injury, I acknowledge that the Company will provide first aid only; the Company is not a medical facility.
7 Media Release (Optional)
I grant IronForge Fitness permission to use my image, name, likeness, and testimonials in promotional materials, social media, and marketing campaigns without compensation. I understand that I can opt out of this clause by notifying the front desk in writing.
8 Governing Law
This agreement shall be governed by and construed in accordance with the laws of the State of [State/Jurisdiction], without regard to its conflict of laws principles. Any legal action or proceeding arising under this Agreement shall be brought exclusively in the federal or state courts located in [County/City, State].
9 Severability
If any provision of this Agreement is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect. If a court finds any part of this agreement invalid, I agree that the court should modify or "blue pencil" that provision to precisely the extent necessary to make it enforceable.
