This section outlines the limitations of liability applicable to the use of Paws Source's website, applications, services, and products. By accessing or using Paws Source, you acknowledge and agree to the terms set forth below.
8.1 General Disclaimer
Paws Source and its affiliates, officers, directors, employees, agents, and suppliers shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Paws Source platform;
- Any conduct or content of any third party on the platform;
- Any content obtained from the platform;
- Unauthorized access, use, or alteration of your transmissions or content;
- Statements or conduct of any third party;
- Any other matter relating to the platform.
8.2 Veterinary Consultation Services
If you utilize any telehealth or veterinary consultation features offered by Paws Source, please note:
- Consultations are for informational purposes and do not establish a veterinarian-client-patient relationship (VCPR) unless explicitly stated in writing and subject to specific state laws.
- Veterinarians providing services through Paws Source are independent contractors and are not employees of Paws Source.
- Paws Source is not responsible for the professional advice, opinions, or recommendations provided by third-party veterinarians.
- In emergency situations, please contact your local emergency veterinary clinic or animal poison control center immediately. Paws Source cannot guarantee immediate response times for non-emergency consultations.
8.3 Product Liability
While we strive to curate only high-quality pet products, Paws Source acts as a marketplace or reseller depending on the transaction type. We are not the manufacturer of most goods sold through our platform. Any warranty or liability regarding the safety, efficacy, or suitability of products is the responsibility of the manufacturer or third-party seller. Paws Source is not liable for any injury, illness, or death to any pet or person arising from the use of products purchased through our services.
8.4 Boarding and Grooming Services
For users of Paws Source's physical or partner-based services (including but not limited to boarding, daycare, and grooming):
- Paws Source and its service partners are not liable for injuries or behavioral issues resulting from interactions between animals, except in cases of proven gross negligence.
- You are responsible for disclosing any known health conditions, behavioral tendencies, or aggression issues of your pet prior to booking any service.
- Liability for services is limited to the fees paid for the specific service booking in which the incident occurred.
8.5 Limitation of Monetary Damages
To the extent permissible under applicable law, the total liability of Paws Source, whether in contract, tort, or otherwise, shall not exceed the greater of (a) the amount actually paid by you to Paws Source for the specific service or product giving rise to the claim during the twelve (12) months preceding the claim, or (b) $100.00 USD.
8.6 Exclusions and Restrictions
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for incidental or consequential damages. Accordingly, some of the limitations in this section may not apply to you. In such cases, our liability shall be limited to the greatest extent permitted by law.
8.7 Survival
The limitations, exclusions, and disclaimers set forth in this Section 8 shall survive the termination of the Terms of Service and your use of the Paws Source platform.
