By booking, accessing, or using the services provided by VoyageLux Travel & Hospitality ("VoyageLux," "we," "our," or "us"), you acknowledge and agree to the following limitation of liability terms. Please read this section carefully before completing any transaction or travel arrangement.
1. Scope of Our Services
VoyageLux operates as a travel intermediary and hospitality coordinator, not as a principal, carrier, hotel operator, or tour operator. Our primary function is to arrange, book, and coordinate travel-related services on your behalf through independently operated third-party providers, including but not limited to airlines, cruise lines, hotels, resorts, transportation services, activity vendors, and insurance brokers.
2. Third-Party Service Limitations
We are not responsible for the acts, omissions, negligence, breaches, or default of any third-party service providers. Any claims arising from cancellations, delays, misrepresentations, substandard services, safety incidents, or personal injury/property damage caused by third parties must be directed to the respective provider. VoyageLux will provide reasonable administrative assistance in facilitating communication with these providers but assumes no legal, operational, or financial liability for their performance or conduct.
3. Force Majeure & Unforeseen Events
VoyageLux shall not be held liable for any failure, delay, or inability to perform our obligations if such failure or delay is caused by events beyond our reasonable control, including but not limited to:
- Natural disasters, pandemics, epidemics, or government-mandated travel restrictions
- Acts of terrorism, war, civil unrest, strikes, or political instability
- Carrier bankruptcies, labor disputes, or severe weather-related disruptions
- Changes in visa/immigration requirements, customs regulations, or public health protocols
- Infrastructure failures, telecommunications outages, or payment processing disruptions
4. Personal Property & Travel Documents
Travelers are solely responsible for securing their personal belongings, travel documents, passports, visas, medications, digital devices, and valuables. VoyageLux is not liable for loss, theft, damage, confiscation, or misplacement of personal items during transit, accommodation stays, guided excursions, or independent travel periods.
5. Travel Changes, Cancellations & Modifications
All travel bookings are subject to the terms, conditions, pricing structures, and cancellation policies of the respective service providers. VoyageLux does not guarantee the availability, pricing, schedule adherence, or uninterrupted operation of any booked service. Refunds, travel credits, fee waivers, or rebooking options are exclusively governed by the original provider's policy and applicable jurisdictional consumer protection laws, not by VoyageLux.
6. Maximum Liability Cap
Under no circumstances shall VoyageLux’s total aggregate liability to you for any claim arising out of or related to these terms, our services, or any travel booking exceed the total amount actually paid by you for the specific reservation in question. This cap applies to all forms of damages, including direct, indirect, incidental, consequential, punitive, or special damages, regardless of the legal theory upon which the claim is based.
7. Indemnification
You agree to indemnify, defend, and hold harmless VoyageLux, its affiliates, officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, penalties, and expenses (including reasonable attorneys’ fees and litigation costs) arising out of your use of our services, violation of these terms, breach of any applicable local or international laws, or non-compliance with third-party provider policies.
8. Disclaimer of Warranties
All services, recommendations, itineraries, and information provided by VoyageLux are furnished "as is" and "as available" without warranties of any kind, either express or implied. This includes, but is not limited to, implied warranties of merchantability, fitness for a particular purpose, accuracy, timeliness, or non-infringement. We do not guarantee that services will be uninterrupted, secure, error-free, or perfectly aligned with your personal preferences or travel expectations.
9. Governing Law & Dispute Resolution
This Limitation of Liability shall be governed by and construed in accordance with the laws of the State of New York, United States, without regard to its conflict of law provisions. Any disputes, claims, or controversies arising from or relating to these terms shall be resolved through binding arbitration in New York County, in accordance with the commercial arbitration rules of the American Arbitration Association (AAA). The prevailing party shall be entitled to recover reasonable attorneys' fees and costs.
