Limitation of Liability

By accessing or using WealthGuard's platform, services, tools, or content (collectively, the "Services"), you acknowledge and agree to the limitations of liability set forth below. This section is integral to our overall Terms of Service and governs the extent of our legal responsibility to you and other users.

1. Services Provided "As Is" and "As Available"

Unless otherwise expressly stated in a separate, signed written agreement, WealthGuard provides its Services on an "AS IS" and "AS AVAILABLE" basis. WealthGuard expressly disclaims all warranties of any kind, whether express, implied, statutory, or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy or completeness of information. We do not guarantee that the Services will be uninterrupted, secure, error-free, or free from harmful components.

2. Limitation of Damages

To the maximum extent permitted by applicable law, in no event shall WealthGuard, its affiliates, directors, officers, employees, agents, or licensors be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities;
• Loss of financial gains, investment returns, or anticipated savings;
• Business interruption, personal injury, or property damage;
• Costs of procurement of substitute goods, services, or data;
• Any other commercial or personal losses, even if advised of the possibility of such damages.

Notwithstanding the foregoing, WealthGuard's total aggregate liability to you for any claim arising out of or related to these terms or the Services shall not exceed the total amount of fees paid by you to WealthGuard in the twelve (12) months immediately preceding the event giving rise to the claim, or $500.00 USD, whichever is greater.

3. Investment & Financial Risk Disclaimer

WealthGuard provides financial planning tools, educational content, portfolio tracking, and advisory services. We do not guarantee specific investment returns, financial outcomes, or tax results. All investing involves risk, including the potential loss of principal. Past performance of any asset, fund, or strategy is not indicative of future results. You are solely responsible for your investment decisions, and WealthGuard shall not be held liable for any financial losses, market fluctuations, or economic downturns resulting from the use of our Services.

4. Third-Party Services & Integrations

Our Services may integrate with or link to third-party platforms, including banking APIs, brokerage accounts, payment processors, and data aggregators. WealthGuard does not control, endorse, or assume responsibility for the content, security, privacy practices, or availability of third-party services. Any disputes, claims, or liabilities arising from third-party services are solely between you and the third party. We shall not be liable for any errors, outages, or data breaches originating from external providers.

5. State Law Exceptions

Some jurisdictions do not allow the exclusion or limitation of implied warranties, incidental or consequential damages, or statutory consumer rights. If such limitations are not permitted in your jurisdiction, they shall apply only to the fullest extent allowed by applicable law. The remaining provisions of this Limitation of Liability section shall remain in full force and effect.

6. Modification & Governing Law

We reserve the right to modify this Limitation of Liability policy at any time. Continued use of the Services following the posting of changes constitutes acceptance of those changes. This section shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles, except where expressly overridden by mandatory consumer protection statutes.
