1. Overview of Intellectual Property

WebCraft Studios ("WebCraft") is committed to respecting and protecting intellectual property rights. This document outlines the ownership, transfer, and usage rights of intellectual property created during the course of web development and design projects for our clients ("Clients").

All intellectual property matters are governed by the specific engagement agreement signed between WebCraft and the Client, supplemented by this policy.

2. Transfer of Ownership

WebCraft operates on a work-for-hire basis for all project-specific deliverables. The following rights transfer to the Client:

• Source Code: Complete ownership of all custom HTML, CSS, JavaScript, and backend code written specifically for the project.
• Design Assets: Final design files, mockups, and prototypes created exclusively for the Client's brand.
• Content: All text, images, and media provided by the Client remain the exclusive property of the Client.
• Domain & Hosting: Any domain names and hosting accounts registered in the Client's name remain their sole property.

Condition of Transfer: All intellectual property rights transfer only after the Client has fulfilled all financial obligations, including final payment and any outstanding balances.

4. Third-Party Assets & Licenses

Projects may incorporate third-party resources. Clients are responsible for understanding the licensing terms associated with these assets:

1. Commercial Fonts: If the Client selects premium fonts, they must acquire the appropriate web font license or reimburse WebCraft for the license cost.
2. Stock Photography: Images sourced from stock libraries are licensed for use. WebCraft provides documentation for all licensed assets upon project delivery.
3. Plugins & Modules: Third-party plugins or modules require active licenses. Clients are responsible for maintaining these licenses post-launch.
4. Open Source Libraries: Projects may use open-source software under MIT, GPL, or Apache licenses. These remain under their respective open-source terms.

5. Client Intellectual Property

WebCraft respects and acknowledges the Client's intellectual property rights:

• Trademarks & Logos: All trademarks, logos, and brand assets provided by the Client remain their exclusive property.
• Content Ownership: Text, images, videos, and other media uploaded or provided by the Client are not claimed by WebCraft.
• Non-Compete: WebCraft does not claim ownership of the Client's business model, customer lists, or proprietary data hosted on the platform.

6. Intellectual Property Infringement

If you believe your intellectual property rights have been infringed upon through content on a WebCraft-developed website, please follow these steps:

1. Contact WebCraft: Send a detailed notice to legal@webcraft.studio.
2. Include Information: Description of the copyrighted work, location of infringing content, contact details, and a statement of good faith.
3. Response Time: WebCraft will acknowledge receipt within 2 business days and investigate the claim promptly.

7. IP Warranty & Indemnification

WebCraft warrants that all custom work delivered to the Client will be original and will not infringe upon any third-party intellectual property rights. In the event a third party claims infringement:

• WebCraft will defend the Client at our expense.
• We will procure necessary licenses, modify the infringing content, or obtain a replacement.
• Client is responsible for indemnifying WebCraft against claims arising from content, assets, or instructions provided by the Client.

8. Modifications & Updates

This Intellectual Property policy may be updated periodically to reflect changes in law, industry standards, or WebCraft's practices. Updates will be communicated via email to active clients and published on this page with a revised "Last Updated" date.
