7. Limitation of Liability

Please read this Limitation of Liability section carefully. This section governs the extent of Wp Admin's liability for damages arising from or related to the use of our WordPress administration services. By accessing or using our services, you agree to these limitations.
7.1 No Warranties
Wp Admin provides all services, including but not limited to website maintenance, security monitoring, performance optimization, backup management, and technical support, on an "AS IS" and "AS AVAILABLE" basis.
To the maximum extent permitted by applicable law, Wp Admin disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:
- Warranties of merchantability, fitness for a particular purpose, and non-infringement;
- Warranties regarding uninterrupted, secure, error-free, or bug-free availability of our services;
- Warranties regarding the accuracy, reliability, or completeness of any data, content, or information provided through the services;
- Any warranty arising from course of dealing, usage, or trade practice.
We do not guarantee that our services will meet your specific requirements or that your WordPress website will remain fully operational, secure, or free from vulnerabilities at all times.
7.2 Exclusion of Damages
To the fullest extent permitted by law, Wp Admin, its affiliates, officers, directors, employees, agents, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of profits, revenue, or business opportunities;
- Loss of data, content, or intellectual property; business interruption; loss of goodwill; or reputational harm;
- Damages resulting from unauthorized access to, alteration of, or disclosure of your data or communications;
- Costs of procuring substitute goods or services;
- Any other damages arising out of or in connection with your use of our services, even if Wp Admin has been advised of the possibility of such damages.
7.3 Cap on Liability
In no event shall Wp Admin's total aggregate liability to you for any claim, whether in contract, tort (including negligence), or otherwise, arising out of or related to this agreement or the services, exceed the total amount of fees paid by you to Wp Admin in the twelve (12) months immediately preceding the date the claim arose.
This cap on liability applies to the entirety of Wp Admin's liability, including for claims by multiple clients arising from the same incident, except where prohibited by mandatory local law.
7.4 Third-Party Services
Wp Admin may utilize third-party services, plugins, themes, hosting providers, and tools as part of our service delivery. We do not guarantee the performance, security, or reliability of such third-party components.
Wp Admin shall not be liable for any damages or losses arising from:
- Failures, outages, or security breaches of third-party hosting providers or infrastructure;
- Vulnerabilities introduced by third-party plugins, themes, or extensions installed on your WordPress site;
- Actions or inactions of third-party developers, vendors, or service providers.
While we strive to select reputable third-party partners and manage integrations carefully, we do not assume liability for issues originating outside our direct control.
7.5 User Responsibility
You acknowledge that you retain full responsibility for:
- The content published on your WordPress website, including compliance with applicable laws and regulations;
- Maintaining accurate and up-to-date access credentials, contact information, and billing details;
- Compliance with all licensing requirements for software, themes, plugins, and media used on your site;
- Implementing adequate local backups as a supplement to our backup services (if applicable);
- Security practices, including using strong passwords and enabling multi-factor authentication where available.
Wp Admin shall not be liable for any damages resulting from your failure to fulfill these responsibilities or for any unauthorized access resulting from compromised credentials provided by you or your team.
7.6 Indemnification
You agree to indemnify, defend, and hold harmless Wp Admin, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, expenses, costs (including reasonable attorneys' fees), and judgments arising out of or related to:
- Your use of the services in violation of this agreement or applicable laws;
- Your content, data, or materials published on your WordPress website;
- Any claims by third parties related to your website or your actions;
- Any breach of your obligations under this agreement.
7.7 Jurisdiction
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability for consequential or incidental damages. Therefore, the above limitations and exclusions may not apply in full to you. In such cases, Wp Admin's liability shall be limited to the maximum extent permitted by the applicable mandatory law of your jurisdiction.
This section shall be severable from the rest of the agreement. If any provision is found to be unenforceable or invalid, the remaining provisions shall remain in full force and effect.
