1. Introduction
Welcome to CloudNexus. This Acceptable Use Policy ("AUP") outlines the standards and guidelines for using our cloud infrastructure, hosting services, and related platforms. By creating an account, deploying workloads, or utilizing any CloudNexus service, you agree to comply with this policy.
CloudNexus is committed to providing a secure, reliable, and high-performance environment for all customers. Violations of this policy may result in service suspension, account termination, or legal action.
2. Prohibited Uses
You may not use CloudNexus services to engage in any illegal, fraudulent, or malicious activity. Prohibited uses include, but are not limited to:
- Conducting or facilitating Distributed Denial of Service (DDoS) attacks, botnets, or any form of network abuse.
- Distributing malware, ransomware, spyware, or malicious scripts.
- Unauthorized scanning, probing, or penetration testing of CloudNexus infrastructure or third-party systems without explicit written consent.
- Impersonating individuals, organizations, or CloudNexus representatives.
- Engaging in phishing, credential harvesting, or social engineering campaigns.
- Operating unauthorized proxy services, tor exit nodes, or open relays.
- Violating any applicable local, national, or international laws, including export control regulations.
Security Note: If you need to conduct authorized security assessments or penetration testing, please contact our Trust & Safety team in advance to arrange a coordinated scope.
3. Content Restrictions
All content hosted, processed, or transmitted through CloudNexus infrastructure must comply with applicable laws and community standards. The following content is strictly prohibited:
- Material that infringes on intellectual property rights, including copyright, trademarks, or patents.
- Content that promotes hate speech, violence, discrimination, or harassment.
- Adult content involving minors or non-consensual imagery.
- Content that facilitates illegal drug trade, weapons trafficking, or human exploitation.
- Spam, unsolicited bulk messaging, or compromised email harvesting.
CloudNexus reserves the right to remove or block access to content that violates this policy or poses a risk to our network and community.
4. Resource & Performance Limits
To ensure fair usage and maintain network stability, all accounts are subject to resource constraints based on your selected plan. Exceeding these limits may trigger throttling or suspension.
4.1 Bandwidth & Storage
Monthly bandwidth and storage allocations are strictly enforced. Burst allowances may be granted temporarily but are not guaranteed. Consistent overage may require plan upgrading.
4.2 Compute & Memory
CPU and memory limits are enforced at the hypervisor/container level. Sustained 100% utilization over a 24-hour period may trigger performance throttling to protect neighboring workloads.
4.3 Prohibited Workloads
- Cryptocurrency mining is prohibited unless explicitly approved via our Enterprise or Dedicated plan tiers.
- Running unapproved peer-to-peer file sharing, torrenting, or high-concurrency connection services on shared infrastructure.
- Excessive outbound connection rates that exceed fair-use thresholds or trigger anti-abuse systems.
5. Enforcement & Termination
CloudNexus monitors infrastructure for policy compliance using automated systems and manual review. Enforcement actions may include:
- Warning: Notification of suspected violation with instructions to remediate within a specified timeframe.
- Temporary Suspension: Service interruption pending investigation or compliance verification.
- Permanent Termination: Account closure for severe, repeated, or malicious violations. Data backups may be retained temporarily per our retention policy, then securely deleted.
Refund eligibility for terminated accounts is evaluated on a case-by-case basis. Violations that endanger network security or violate criminal statutes will not qualify for prorated refunds.
6. Reporting Violations
If you suspect a CloudNexus customer is violating this policy, or if your intellectual property has been infringed, please report it immediately.
- General Abuse: abuse@cloudnexus.io
- DMCA / Copyright Claims: legal@cloudnexus.io
- Security Incidents: security@cloudnexus.io
All reports are treated confidentially and investigated within 48 hours. False or malicious reports may result in account review.
7. Policy Updates
CloudNexus may update this Acceptable Use Policy periodically to reflect changes in technology, legal requirements, or operational standards. Significant changes will be communicated via email or platform notification at least 30 days before the effective date. Continued use of our services after the effective date constitutes acceptance of the updated policy.
