This Limitation of Liability policy ("Policy") governs your use of the Dictionary platform, including its web application, mobile applications, API services, and related tools (collectively, the "Service"). By accessing or using the Service, you acknowledge and agree to the terms set forth below. If you do not agree with any part of this Policy, you must discontinue use of the Service immediately.
Important Notice: The information provided through Dictionary is for general reference and educational purposes only. Dictionary does not guarantee the absolute accuracy, completeness, or timeliness of any linguistic, definitional, or translation data.
1. Disclaimer of Warranties
YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE SERVICE, INCLUDING ALL DEFINITIONS, TRANSLATIONS, PRONUNCIATION GUIDES, ETYMOLOGIES, AND AI-GENERATED INSIGHTS, ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, DICTIONARY AND ITS AFFILIATES, DIRECTORS, EMPLOYEES, AND LICENSORS DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND UNINTERRUPTED OPERATION.
2. Limitation of Damages
IN NO EVENT SHALL DICTIONARY OR ITS SUPPLIERS, PARTNERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to or use of (or inability to access or use) the Service;
- Any conduct or content of any third party on the Service;
- Any content obtained from the Service; and
- Unauthorized access, use, or alteration of your transmissions or content.
DIRECT LIABILITY SHALL BE LIMITED TO THE AMOUNT ACTUALLY PAID BY YOU TO DICTIONARY IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100 USD, WHICHEVER IS GREATER. THIS LIMITATION APPLIES TO ALL CLAIMS, WHETHER ARISING IN CONTRACT, TORT, OR OTHERWISE.
3. User Responsibilities & Indemnification
You are solely responsible for your use of the Service and for any reliance placed on the information provided therein. Dictionary does not endorse, verify, or guarantee the accuracy of user-generated content, third-party integrations, or external links.
You agree to indemnify, defend, and hold harmless Dictionary, its officers, directors, employees, agents, affiliates, successors, and assigns from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, your violation of this Policy, or your violation of any rights of any third party.
4. Third-Party Services & External Links
The Service may contain links to third-party websites, APIs, translation services, or linguistic databases. Dictionary does not control, endorse, or assume responsibility for the content, accuracy, privacy practices, or terms of use of any third-party resources. Access to third-party services is at your own risk.
5. Service Interruptions & Maintenance
Dictionary may suspend, modify, or discontinue all or any part of the Service at any time, without prior notice, for maintenance, security updates, legal compliance, or operational reasons. Dictionary shall not be liable for any inconvenience, data loss, or business disruption resulting from such interruptions.
6. Governing Law & Dispute Resolution
This Policy shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any disputes arising out of or relating to this Policy shall be resolved exclusively in the federal or state courts located in Newark, Delaware. You hereby consent to the personal jurisdiction and venue therein.
7. Severability & Modifications
If any provision of this Policy is held to be unenforceable or invalid, such provision shall be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions shall continue in full force and effect.
Dictionary reserves the right to update, modify, or replace this Policy at any time. Continued use of the Service following the posting of changes constitutes acceptance of those changes.
