By accessing or using Dictionary, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not use the Service.

We recommend reviewing these Terms periodically, as we may update them from time to time. Your continued use of the Service following any changes constitutes acceptance of those changes.

  • "Service" refers to Dictionary's web platform, mobile applications, browser extensions, and associated APIs.
  • "User" or "You" refers to any individual or entity accessing or using the Service.
  • "Content" includes definitions, translations, pronunciations, etymologies, examples, and linguistic data provided by Dictionary.
  • "User Content" refers to any data, feedback, reviews, or submissions you provide while using the Service.
  • "Subscription" refers to a paid plan granting access to premium features under these Terms.

3. User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Update your information to keep it accurate and complete.
  • Notify us immediately of any unauthorized use or security breach.
  • Not share, sell, or transfer your account credentials to third parties.

5. Intellectual Property Rights

All Content, including but not limited to text, graphics, logos, audio pronunciations, software, and design elements, is the exclusive property of Dictionary or its licensors and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any right to use Dictionary's trademarks, logos, or brand assets without prior written consent.

Dictionary grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your intended purpose during your subscription period.

6. User Contributions & Content

If you submit feedback, suggestions, translations, or other materials ("User Contributions"), you grant Dictionary a perpetual, worldwide, royalty-free, fully paid-up, transferable, and sublicensable license to use, reproduce, modify, distribute, and display such contributions for any purpose, including improving the Service, marketing, and creating derivative works. Dictionary is not obligated to monitor, edit, or respond to User Contributions, but reserves the right to remove any content that violates these Terms.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY OF DEFINITIONS AND TRANSLATIONS.

While Dictionary strives for linguistic accuracy, language is dynamic and context-dependent. We do not guarantee that definitions, translations, or pronunciations will be error-free, complete, or suitable for professional, academic, or legal contexts without independent verification.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DICTIONARY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100 USD FOR FREE TIER USERS, WHICHEVER IS LESS.

9. Privacy & Data Protection

Your privacy is important to us. Our collection, use, storage, and sharing of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the practices described in the Privacy Policy.

10. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email, in-app notification, or by posting a prominent notice on the Service at least thirty (30) days prior to the effective date. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules, conducted solely on an individual basis in Wilmington, Delaware. Class action lawsuits and class-wide arbitration shall not be permitted.
