EliteCircle Terms of Use

1. Acceptance of Terms

By accessing, browsing, or using the EliteCircle platform, including our website, mobile applications, courses, community features, and associated services (collectively, the "Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and EliteCircle. By creating an account or making a purchase, you confirm that you are at least 18 years of age or have the legal capacity to enter into a binding agreement.

2. Membership & Subscription Services

EliteCircle operates on a subscription-based membership model. Depending on the plan selected, you may gain access to educational courses, live coaching sessions, community forums, AI-powered learning paths, and supplementary materials.

                        Subscription Billing: Subscriptions renew automatically at the end of each billing cycle unless canceled prior to the renewal date. You will be charged the applicable fee for your selected plan on a monthly or annual basis.
                    

Pricing, plan features, and available content may change at EliteCircle's sole discretion. You are responsible for maintaining payment methods on file and authorizing recurring charges.

3. User Accounts & Security

To access certain features, you must create an account. You agree to:

Provide accurate, current, and complete registration information
Maintain the security of your account credentials and password
Accept responsibility for all activities that occur under your account
Notify us immediately of any unauthorized use or security breach

EliteCircle reserves the right to suspend or terminate accounts that violate these Terms or exhibit suspicious activity.

4. Permitted Use & Code of Conduct

You may use the Service for personal, non-commercial educational purposes in accordance with your subscription level. You agree not to:

Share, sell, or distribute course materials, recordings, or proprietary content
Use automated bots, scrapers, or unauthorized APIs to access the platform
Harass, abuse, or discriminate against other members in community spaces
Post spam, malware, or unlawful content in forums or chat channels
Attempt to reverse-engineer, decompile, or extract platform source code

Violations may result in immediate termination, forfeiture of access, and legal action where applicable.

5. Intellectual Property & Content License

All content provided through EliteCircle, including but not limited to courses, videos, text, graphics, logos, AI algorithms, software, and community guidelines, is the exclusive property of EliteCircle or its licensors and is protected by copyright, trademark, and other intellectual property laws.

Upon valid subscription, you are granted a limited, non-exclusive, non-transferable, revocable license to access and use the content solely for your personal educational use. This license terminates immediately upon cancellation, expiration, or violation of these Terms.

6. Third-Party Services & Links

The Service may contain links to third-party websites, tools, payment processors, or integrations. EliteCircle does not endorse, control, or assume responsibility for third-party content, privacy practices, or terms of service. Use of third-party services is at your own risk.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ERROR-FREE OPERATION.

EliteCircle does not guarantee specific career outcomes, income levels, or educational results. Progress depends on your effort, consistency, and individual circumstances.

8. Limitation of Liability

To the maximum extent permitted by law, EliteCircle and its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use or inability to use the Service.

Our total aggregate liability shall not exceed the amount you paid to EliteCircle in the twelve (12) months preceding the claim.

9. Termination

You may terminate your account at any time through your account settings or by contacting support. EliteCircle reserves the right to suspend or terminate your access immediately for conduct that breaches these Terms, threatens user safety, or violates applicable laws. Upon termination, your right to access the Service ceases immediately.

10. Refund & Cancellation Policy

All subscriptions are eligible for a 30-day money-back guarantee from the date of initial purchase, provided no more than 20% of core course content has been accessed. Refund requests must be submitted via our support portal. After the 30-day window, refunds are evaluated on a case-by-case basis. Annual plan refunds are prorated and subject to administrative review.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall first be resolved through good-faith negotiation. If unresolved, disputes shall be settled by binding arbitration administered by the American Arbitration Association in Wilmington, DE, waiving rights to class action proceedings.

12. Modifications to These Terms

EliteCircle reserves the right to modify these Terms at any time. Material changes will be communicated via email or platform notification at least 30 days prior to effectiveness. Continued use of the Service after such notice constitutes acceptance of the revised Terms.
