1. Acceptance of Terms
By accessing or using the GeoServer platform, APIs, documentation, or related services (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must discontinue use of the Service immediately.
2. Description of Service
GeoServer provides enterprise-grade geospatial infrastructure, including but not limited to map rendering engines, spatial data ingestion pipelines, real-time telemetry processing, WMS/WFS/WCS API endpoints, and cloud-hosted or self-managed deployment options. We reserve the right to modify, suspend, or discontinue any feature or service at our sole discretion, with reasonable notice where practicable.
3. Account Registration & Security
To access certain features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your account credentials and API keys.
- Accept responsibility for all activities occurring under your account.
- Notify GeoServer immediately of any unauthorized access or security breach.
4. Acceptable Use Policy
You may not use the Service to:
- Violate any applicable local, national, or international law or regulation.
- Infringe upon the intellectual property, privacy, or other rights of third parties.
- Upload, transmit, or store malicious code, geospatial data containing personally identifiable information (PII) without explicit consent, or restricted military/classified datasets.
- Attempt to reverse-engineer, decompile, or scrape the Service beyond documented API usage limits.
- Use the Service for automated mass scraping, denial-of-service attacks, or unauthorized commercial redistribution.
5. Intellectual Property Rights
All content, branding, source code, documentation, APIs, map tiles, and software provided by GeoServer are owned by GeoServer or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for your internal business or educational purposes as outlined in your subscription plan.
6. Data, Privacy & Security
Your use of the Service is also governed by our Privacy Policy. GeoServer implements industry-standard encryption, access controls, and infrastructure monitoring to protect spatial datasets. You retain ownership of all user-uploaded geospatial data, but grant us a limited license to process, store, and render such data solely to deliver the Service. We do not sell, lease, or otherwise commercialize customer data.
7. Service Availability & Maintenance
We strive for 99.9% uptime for cloud-hosted tiers, but do not guarantee uninterrupted or error-free operation. Scheduled maintenance may occur with advance notice. Force majeure events, including but not limited to natural disasters, telecommunications failures, or government actions, may temporarily affect Service availability without liability.
8. Limitation of Liability & Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. GeoServer shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of geospatial data, business interruption, or inaccurate mapping outputs, arising from your use or inability to use the Service.
9. Indemnification
You agree to indemnify, defend, and hold harmless GeoServer, its affiliates, officers, directors, and employees from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of your violation of these Terms, misuse of the Service, or infringement of any third-party rights.
10. Termination
We may suspend or terminate your account and access to the Service immediately, without prior notice or liability, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. Upon termination, your right to use the Service will cease immediately, and any outstanding fees will become due and payable.
11. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under these Terms shall first be subject to good-faith negotiation. If unresolved, disputes may be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, or in a court of competent jurisdiction within California.
12. Amendments to Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated via email, in-app notification, or a prominent notice on the Service. Your continued use of the Service after such changes constitutes acceptance of the updated Terms.
