1. Overview

HomeNest Property Management Services operates in strict accordance with federal, state, and local laws governing real estate, property management, tenant-landlord relations, and data protection. This document outlines our legal framework, compliance standards, and user rights. By engaging with our services, utilizing our platform, or entering into a management agreement, you acknowledge and agree to these terms.

We maintain an internal compliance division that regularly audits our practices to ensure alignment with evolving legislation and industry best practices.

2. Privacy Policy & Data Protection

2.1 Information We Collect

We collect personal and property information necessary to provide our services, including but not limited to: identification documents, financial records, lease agreements, maintenance histories, communication logs, and property inspection reports.

2.2 Data Usage & Security

All data is encrypted in transit and at rest using industry-standard protocols (AES-256, TLS 1.3). Information is solely used for property management operations, legal compliance, fraud prevention, and service improvement. We do not sell, rent, or share personal data with third parties except as required by law or to fulfill contractual obligations.

2.3 User Rights

In accordance with CCPA, GDPR, and other applicable data protection laws, you have the right to access, correct, delete, or export your personal data. Requests may be submitted via our secure portal or to privacy@homenest.com.

3. Terms of Service & User Agreement

3.1 Account & Eligibility

Users must be at least 18 years of age and legally competent to enter binding contracts. Each user is responsible for maintaining the confidentiality of their account credentials and for all activities occurring under their account.

3.2 Payment & Financial Obligations

Management fees, maintenance retainers, and late payment penalties are processed as outlined in your executed Property Management Agreement. HomeNest reserves the right to suspend services for unpaid balances exceeding 30 days.

3.3 Termination

Either party may terminate the management agreement with 60 days written notice, unless otherwise specified in the contract. Early termination fees and settlement procedures will be applied as contractually defined.

4. Fair Housing & Anti-Discrimination Policy

HomeNest strictly adheres to the Federal Fair Housing Act, Americans with Disabilities Act (ADA), and all applicable state and local anti-discrimination laws. We provide equal housing opportunity regardless of race, color, religion, sex, national origin, familial status, disability, or any other protected class under applicable law.

Our tenant screening process utilizes objective, standardized criteria. Accommodation requests for disabilities are processed within statutory timeframes. Discriminatory complaints may be reported to our compliance office or directly to HUD.

5. Regulatory & Industry Compliance

5.1 Licensing & Registration

HomeNest holds all required state real estate and property management licenses. Brokerage operations comply with state regulatory boards, and all managing agents maintain current certifications.

5.2 Property Standards & Safety

All managed properties undergo regular compliance inspections to meet local housing codes, fire safety regulations, lead paint disclosures, mold abatement standards, and accessibility requirements.

5.3 Financial Compliance

Tenant security deposits and rent funds are held in segregated, FDIC-insured trust accounts as required by state law. Quarterly reconciliation reports are available to property owners upon request.
