3. Property Information & Accuracy Disclaimer
Property listings, pricing, square footage, lot dimensions, zoning classifications, HOA fees, tax assessments, and availability information published on Luxe Realty websites, applications, or marketing materials are sourced from multiple listing services (MLS), public records, third-party vendors, or property owners. While we exercise reasonable care to ensure accuracy, Luxe Realty does not guarantee, warrant, or assume legal liability for the completeness, reliability, or timeliness of such data.
All prospective buyers, tenants, and investors are strongly advised to:
- Verify all material facts independently through licensed professionals (inspectors, surveyors, attorneys, tax assessors).
- Confirm pricing, availability, and terms directly with the listing brokerage prior to submitting offers.
- Recognize that property conditions, measurements, and municipal regulations may change without notice.
4. Material Disclosures & Conflict of Interest
Luxe Realty complies with all statutory requirements regarding material fact disclosures. Sellers and landlords are obligated to disclose known material defects, past damage, environmental hazards, boundary disputes, and other conditions that could affect property value or desirability. Luxe Realty's role is to facilitate proper disclosure documentation and advise clients to seek independent legal and inspection counsel.
Dual Agency & Transaction Facilitation
Where permitted by state law, Luxe Realty may act as a dual agent or transaction facilitator. In such cases, written consent from all parties is required prior to representation. Dual agency does not impair our duty to disclose known material facts, maintain honesty, and ensure fair treatment for all parties involved.
Affiliate & Referral Disclosures
Luxe Realty may receive referral fees or compensation from third-party service providers (lenders, title companies, inspectors, insurance brokers). All material financial relationships are disclosed to clients prior to engagement. Clients are never required to use recommended vendors.
5. Privacy & Data Protection
Luxe Realty is committed to protecting the confidentiality and security of personal information collected through our websites, applications, and brokerage services. We comply with applicable data protection regulations, including but not limited to the California Consumer Privacy Act (CCPA) and GDPR for international users.
Data Collection & Usage
We collect personally identifiable information (PII) including name, contact details, financial qualifications, property preferences, and transaction history solely for the purpose of facilitating real estate services, marketing communications (with opt-out consent), regulatory compliance, and fraud prevention.
Third-Party Sharing
Personal data is never sold to third parties. Information may be shared with:

6. Lead-Based Paint & Environmental Disclosures
In accordance with the Residential Lead-Based Paint Hazard Reduction Act (Title X) and federal EPA guidelines, all housing properties constructed prior to 1978 may contain lead-based paint. Sellers, landlords, and agents are legally required to provide:
- Lead-based paint disclosure forms
- Approved informational pamphlets ("Protect Your Family from Lead in Your Home")
- A 10-day inspection period for buyers to assess lead hazards
Luxe Realty ensures all pre-1978 transactions include proper documentation. Additional environmental disclosures may apply for properties near industrial sites, flood zones, seismic activity areas, or known contamination zones. Clients are advised to retain qualified environmental consultants for site-specific assessments.
