1. Acceptance of Terms

By accessing, browsing, or using the Luxe Realty website, mobile applications, or any associated services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease use of the Platform.

These Terms constitute a legally binding agreement between you ("User," "Client," or "You") and Luxe Realty, LLC ("Company," "We," "Us," or "Our").

2. Definitions

• "Platform" refers to all Luxe Realty digital properties, including websites, mobile apps, portals, and related services.
• "Property Listings" refers to real estate advertisements, descriptions, photographs, floor plans, pricing, and location data displayed on the Platform.
• "Services" refers to brokerage, advisory, property management, transaction coordination, and consulting services offered by Luxe Realty.
• "User" refers to any individual or entity accessing or using the Platform, including prospective buyers, sellers, renters, and investors.

3. Services Provided

Luxe Realty provides real estate brokerage, property search assistance, valuation consultations, transaction coordination, and advisory services. All services are subject to applicable state and federal real estate licensing laws.

4. User Accounts & Registration

Certain features of the Platform may require account creation. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain the security of your account credentials and password.
• Notify us immediately of any unauthorized access or security breach.
• Accept responsibility for all activities conducted under your account.

We reserve the right to suspend or terminate accounts that violate these Terms or applicable laws, without prior notice.

5. Property Listings & Information Accuracy

Property listings are provided by sellers, landlords, and licensed brokerage partners. While we strive for accuracy, Luxe Realty does not warrant, represent, or guarantee the completeness, reliability, or timeliness of listing data, including but not limited to square footage, pricing, lot dimensions, zoning status, or HOA rules.

Users are responsible for conducting independent inspections, title searches, and verifications. All listings are subject to prior sale, withdrawal, or modification without notice.

6. Fees, Commissions & Transactions

Brokerage commissions, administrative fees, and service charges are outlined in separate engagement agreements or listing contracts. Fees are typically calculated as a percentage of the transaction value or a fixed flat rate, payable upon successful closing or service completion.

Failure to pay agreed-upon fees may result in suspension of services, collection actions, or legal remedies as permitted by law. All payments are subject to applicable taxes and regulatory fees.

7. Intellectual Property

All content on the Platform, including logos, branding, photography, virtual tours, copywriting, software, and database structures, is the exclusive property of Luxe Realty or its licensed partners. Unauthorized reproduction, distribution, scraping, or commercial use of Platform content is strictly prohibited without prior written consent.

Users may share property listings for personal, non-commercial purposes, provided proper attribution to Luxe Realty is maintained.

8. User Conduct & Restrictions

You agree not to:

• Use the Platform for illegal, fraudulent, or discriminatory purposes.
• Post false, misleading, or harmful information regarding properties or agents.
• Circumvent platform security, automate data extraction, or deploy scraping tools.
• Harass, threaten, or intimidate agents, sellers, buyers, or third parties.
• Violate fair housing laws or engage in discriminatory practices.

Violation of these restrictions may result in immediate account termination and legal action.

9. Disclaimers & Limitation of Liability

The Platform and all services are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. Luxe Realty explicitly disclaims warranties of merchantability, fitness for a particular purpose, and non-infringement.

To the maximum extent permitted by law, Luxe Realty shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform, inability to access services, or reliance on listing information. Our total liability shall not exceed the amount of fees paid by you in the preceding twelve (12) months.

10. Privacy & Data Protection

Your use of the Platform is also governed by our Privacy Policy. We collect, process, and store personal data in accordance with applicable data protection regulations, including GDPR, CCPA, and state-level real estate compliance statutes. You retain the right to access, correct, or request deletion of your personal information, subject to legal retention requirements.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles.

Any dispute arising from or relating to these Terms or the Platform shall first be subject to good-faith negotiation. If unresolved within thirty (30) days, disputes shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in Los Angeles, CA. Class action waivers and jury trial waivers apply.

12. Modifications to Terms

Luxe Realty reserves the right to modify, update, or replace these Terms at any time. Material changes will be communicated via email, Platform notification, or prominent banner. Continued use of the Platform following the effective date of revised Terms constitutes acceptance of the changes.
