1. Acceptance of Terms
By accessing, browsing, or booking any service through SummitX Adventures ("Company", "we", "us", or "our"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree with any part of these terms, you must not use our services.
These terms govern all guided expeditions, trekking trips, camping tours, and adventure bookings facilitated by SummitX Adventures, whether purchased directly through our website, booking partners, or authorized agents.
2. Eligibility & Fitness Requirements
Participation in SummitX Adventures is restricted to individuals who meet the following criteria:
- Age Requirement: Most trips require participants to be at least 16 years old. Minors (16-17) must provide signed parental/guardian consent and a completed medical waiver. Some technical or high-altitude expeditions require participants to be 18 or older.
- Physical Fitness: You are responsible for ensuring your physical and mental condition is suitable for the selected adventure. Many trips involve strenuous activity, high altitudes, rugged terrain, and extreme weather. Please review the difficulty rating and fitness notes for each expedition.
- Medical Conditions: Participants must disclose any pre-existing medical conditions, allergies, or medications during booking. SummitX reserves the right to decline participation if a condition poses an unacceptable risk to the participant or the group.
3. Booking & Payments
All bookings are subject to availability and confirmation by SummitX Adventures. A deposit is required to secure your spot, with the remaining balance due 30 days prior to the departure date unless otherwise stated.
- Pricing is per person and includes the services explicitly listed in the trip itinerary (guided support, accommodation, meals, permits, etc.).
- International transactions may be subject to currency conversion fees and bank charges.
- By completing a booking, you certify that all information provided is accurate and that you have read the detailed itinerary, packing list, and preparation guide.
4. Cancellation & Refund Policy
Refund eligibility depends on the timing of your cancellation relative to the departure date:
- 60+ days prior: Full refund of deposit and balance, minus a $75 administrative fee.
- 30-59 days prior: 50% refund of total amount paid.
- 15-29 days prior: 25% refund of total amount paid.
- Less than 15 days / No-Show: No refund. Alternative options include trip credit (valid for 12 months) or transfer to another participant (subject to a $100 processing fee).
Refund requests must be submitted in writing. Travel insurance claims are processed directly between you and your insurer; SummitX does not manage or guarantee insurance payouts.
5. Inherent Risks & Safety Disclaimer
Outdoor adventure activities involve inherent and unavoidable risks, including but not limited to: injury, illness, equipment failure, extreme weather, wildlife encounters, altitude sickness, and remote terrain hazards.
Participants must follow all instructions from guides and safety officers. Failure to comply may result in immediate removal from the trip at the participant's expense, with no refund provided.
6. Participant Conduct
We maintain a respectful, inclusive, and environmentally responsible expedition culture. Participants agree to:
- Follow all local laws, cultural norms, and conservation regulations.
- Practice Leave No Trace principles and minimize environmental impact.
- Avoid substance abuse, reckless behavior, or actions that endanger themselves or others.
- Refrain from harassment, discrimination, or disruptive conduct toward staff or fellow travelers.
SummitX reserves the right to terminate participation and remove any individual whose behavior compromises safety, group harmony, or environmental standards. No refunds will be issued for conduct-related removals.
7. Equipment & Gear
SummitX provides group equipment as specified in each trip's packing list (e.g., tents, stoves, ropes, navigation tools). Personal gear (clothing, boots, backpacks, sleeping bags) is the sole responsibility of the participant.
We recommend using reliable, properly maintained equipment. Guides may inspect personal gear prior to departure to ensure it meets safety and trip requirements. Failure to bring mandatory equipment may result in denial of entry to the expedition.
8. Photography & Media Rights
SummitX Adventures may photograph, film, audio-record, and document participants during trips for promotional, editorial, and social media purposes. By booking, you grant SummitX a non-exclusive, royalty-free, worldwide license to use such media.
If you prefer not to be featured, please notify your trip leader in writing prior to departure. Your name and likeness may still appear in non-identifiable ways (e.g., back-of-head shots, group panoramas). Participants are responsible for obtaining any necessary permissions when photographing other individuals.
9. Limitation of Liability & Indemnification
To the fullest extent permitted by applicable law, SummitX Adventures, its owners, employees, guides, and partners shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your participation, including lost earnings, emotional distress, property damage, or medical expenses.
You agree to indemnify and hold harmless SummitX Adventures from any claims, losses, or expenses (including legal fees) resulting from your negligence, violation of these terms, breach of local laws, or unauthorized activities outside guided supervision.
10. Force Majeure & Itinerary Modifications
SummitX Adventures is not liable for delays, cancellations, or itinerary changes caused by events beyond our reasonable control, including but not limited to: natural disasters, political instability, civil unrest, transportation strikes, extreme weather, pandemics, or permit restrictions.
In such events, we will make reasonable efforts to ensure participant safety and provide alternative arrangements or pro-rated refunds where possible. Travel insurance is strongly advised to cover force majeure scenarios.
11. Governing Law & Dispute Resolution
These Terms & Conditions are governed by the laws of the State of Colorado, United States, without regard to conflict of law principles. Any disputes arising from your booking or participation shall first be addressed through good-faith negotiation, followed by mandatory mediation in Denver, Colorado. If mediation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
12. Modifications to Terms
SummitX Adventures reserves the right to update, modify, or replace these Terms & Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of the revised terms. We recommend reviewing this page periodically.
