Section 9.5: Exceptions to Limitations

This section outlines specific, pre-authorized exceptions to the standard usage limitations, access restrictions, and service boundaries defined in Sections 9.1 through 9.4 of the That Is A Q Terms of Service. These exceptions are strictly governed by compliance requirements, enterprise agreements, and approved partnership frameworks.

9.5.1 Scope & Applicability

Standard service limitations apply universally to all individual, standard, and premium accounts unless explicitly overridden by a written exception agreement. Exceptions granted under this section do not transfer automatically to sub-accounts, third-party integrations, or successor entities without prior written approval from That Is A Q's Legal & Compliance department.

9.5.2 Approved Exception Categories

The following categories qualify for limitation exemptions, subject to eligibility verification and contractual addenda:

  1. Enterprise Volume Agreements: Clients operating under an approved Enterprise contract may request scaled API rate limits, concurrent user thresholds, and storage allocations exceeding standard plan caps.
  2. Regulatory & Compliance Mandates: Organizations required by jurisdictional regulations (e.g., HIPAA, GDPR, SOC 2, PCI-DSS) to maintain specific data retention periods, audit log volumes, or access permissions may receive temporary or permanent limit adjustments.
  3. Research & Academic Partnerships: Accredited institutions engaged in approved collaborative research projects may request sandbox environment expansions, extended compute windows, and unrestricted dataset sampling within ethical guidelines.
  4. Critical System Integration: Third-party vendors certified under the That Is A Q Partner Program may receive elevated webhook frequency, priority queue access, and relaxed rate throttling for mission-critical integrations.
  5. Emergency & Disaster Recovery: In the event of verified system outages, natural disasters, or business continuity emergencies, That Is A Q may temporarily suspend standard limitations to facilitate restoration and data integrity.
Important Notice: All exceptions are subject to periodic review. That Is A Q reserves the right to revoke, modify, or sunset any granted exception if usage patterns deviate from the approved scope, security thresholds are breached, or compliance requirements change.

9.5.3 Eligibility & Request Process

To request an exception to standard limitations, the account holder must submit a formal request through the That Is A Q Legal Portal or contact legal@thatisaq.com. Requests must include:

That Is A Q will review all submissions within 10–15 business days. Approved exceptions will be formalized via a Limited Addendum Agreement (LAA) and deployed within 5 business days of execution.

9.5.4 Monitoring & Enforcement

All accounts operating under an exception are subject to enhanced monitoring protocols. That Is A Q will maintain automated usage telemetry and will issue a 14-day advance notice if activity approaches 90% of the approved exception threshold. Persistent overage without renewal or re-scoping may result in automatic reversion to standard limitations or service suspension.

9.5.5 Liability & Indemnification

Granting an exception does not alter the limitation of liability, warranty disclaimers, or indemnification obligations outlined in Sections 8 and 10 of this agreement. Account holders remain fully responsible for compliance with applicable laws, data security standards, and acceptable use guidelines while operating under an exception.
