1. Acceptance of Terms
By engaging TimberCraft Pro ("Company", "we", "our", or "us") for carpentry contracting services, you ("Client", "you", or "your") agree to be bound by these Terms of Service. These terms govern all residential and commercial projects, including estimates, proposals, contracts, and subsequent work performed.
If you do not agree to these terms, please do not request or authorize any work from TimberCraft Pro. Continued engagement after modifications to these terms constitutes acceptance of the revised conditions.
2. Scope of Services
TimberCraft Pro provides professional carpentry contracting services including, but not limited to: custom cabinetry, deck and patio construction, door and window installation, home renovations, custom built-ins, and commercial fit-outs. All services will be performed in accordance with industry standards, local building codes, and applicable regulations.
3. Estimates & Pricing
All estimates provided are based on the information available at the time of assessment. Final pricing may vary due to unforeseen structural conditions, material availability, code requirements, or changes in project scope. Estimates remain valid for 30 days from the date of issue unless otherwise stated in writing.
- Estimates include labor, standard materials, permits (if applicable), and project management.
- Exclusions and potential additional costs will be clearly outlined in the Project Agreement.
- Material prices are subject to market fluctuations; significant changes may be adjusted with prior Client notification.
4. Payment Terms
Unless otherwise specified in the Project Agreement, payment shall be structured as follows:
- Deposit: 30–40% upon signing the contract to secure scheduling and order materials.
- Progress Payments: Issued at predetermined milestones (e.g., framing completion, installation phase).
- Final Payment: Due upon substantial completion and client walkthrough acceptance.
Payments are due within 7 days of invoice. Late payments may incur a 1.5% monthly finance charge. Work may be suspended if payments are overdue beyond 14 days.
5. Project Timeline & Delays
TimberCraft Pro will make reasonable efforts to complete projects within the estimated timeframe outlined in the Project Agreement. However, carpentry work is subject to variables beyond our control, including:
- Weather conditions affecting outdoor work or material delivery
- Material delays from suppliers or mills
- Unforeseen structural or code compliance issues discovered during demolition/prep
- Client-requested changes or delayed approvals
- Permitting or inspection scheduling constraints
In the event of delays, TimberCraft Pro will provide timely written or verbal notice and adjust the schedule accordingly. We are not liable for consequential damages resulting from project delays.
6. Client Responsibilities
To ensure project success, Clients agree to:
- Provide clear, timely access to the work site during agreed-upon hours
- Remove personal belongings, valuables, and obstructive items from work areas
- Secure necessary homeowner association (HOA) approvals or property permissions
- Pet and child supervision during active construction hours
- Make timely decisions and selections regarding materials, finishes, and design changes
- Ensure utilities (water, electricity) are available and functional for work requirements
7. Changes & Additions
Any modifications to the original scope of work must be documented in a written Change Order signed by both parties. Change Orders will specify adjustments to pricing, timeline, and materials. Verbal agreements or informal requests do not constitute binding modifications to the contract. Work on changes will not commence until the Change Order is approved.
8. Warranty & Guarantees
TimberCraft Pro provides a standard workmanship warranty of five (5) years from project completion, covering defects in construction, joinery, and installation. This warranty does not cover:
- Normal wear and tear, finish patina, or wood movement
- Damage caused by misuse, neglect, improper maintenance, or third-party alterations
- Manufacturer defects on materials, hardware, or finishes (covered by respective warranties)
- Structural damage resulting from foundation settling, water intrusion, or environmental factors
Warranty claims must be reported in writing within 30 days of discovery. Remedies are limited to repair or replacement of the defective work at TimberCraft Pro's discretion.
9. Limitation of Liability
TimberCraft Pro's total liability under these terms shall not exceed the total contract price paid by the Client for the specific project in question. We shall not be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, business interruption, or property value diminution.
10. Insurance & Safety
TimberCraft Pro maintains comprehensive general liability insurance, workers' compensation, and commercial auto coverage as required by law. Clients may request certificates of insurance prior to project commencement. We adhere to OSHA standards and industry best practices for job site safety.
11. Intellectual Property
Custom designs, 3D renderings, blueprints, and technical drawings created by TimberCraft Pro remain the intellectual property of the Company. Clients are granted a non-exclusive, non-transferable license to use these materials solely for the intended project. Reproduction or use of our proprietary designs for other projects requires written permission and may incur additional licensing fees.
12. Dispute Resolution
In the event of a dispute arising from these terms or project performance, both parties agree to first attempt resolution through good-faith negotiation. If unresolved within 30 days, parties agree to submit to binding mediation in accordance with the rules of the American Arbitration Association. If mediation fails, disputes shall be resolved through binding arbitration in the county where the project was performed. The prevailing party may be entitled to recover reasonable legal fees and costs.
13. Termination
Either party may terminate the agreement with 14 days written notice. Upon termination, the Client agrees to pay for all work completed, materials ordered, and non-cancelable commitments incurred up to the termination date. TimberCraft Pro reserves the right to suspend or terminate work immediately if payment terms are violated or site conditions pose safety risks.
14. Modifications to Terms
TimberCraft Pro reserves the right to modify these Terms of Service at any time. Updates will be posted on our website with a revised "Last Updated" date. Continued use of our services following modifications constitutes acceptance of the revised terms. Clients are encouraged to review this page periodically.
