Acceptable Use Policy

1. Scope & Purpose

CloudNexus provides high-performance cloud infrastructure, virtual servers, object storage, and managed database services. This Acceptable Use Policy ("AUP") outlines the standards and guidelines for using our network, servers, and associated services. By accessing or using CloudNexus infrastructure, you acknowledge that you have read, understood, and agree to abide by this policy.

This AUP supplements our Terms of Service and Service Level Agreement. In the event of a conflict, the Terms of Service shall prevail.

2. Permitted Uses

CloudNexus infrastructure may be used for lawful commercial, personal, educational, and development purposes, including but not limited to:

• Hosting websites, web applications, APIs, and microservices
• Running databases, caches, and message queues
• Development, staging, and continuous integration/continuous deployment (CI/CD) pipelines
• File storage, backup, and disaster recovery solutions
• Running containerized workloads (Docker, Kubernetes)
• Legitimate data processing, analytics, and machine learning workloads

3. Prohibited Activities

The following activities are strictly prohibited on CloudNexus infrastructure. Violations may result in immediate suspension or termination without notice.

• Illegal Activities: Any use that violates local, national, or international laws, including but not limited to fraud, theft, harassment, or distribution of illegal content.
• Malware & Exploits: Hosting, distributing, or executing viruses, ransomware, bots, exploits, or unauthorized scanning tools.
• Spam & Unsolicited Communications: Sending bulk emails, SMS, or notifications without explicit recipient consent or proper authentication (SPF, DKIM, DMARC).
• Network Abuse: Launching DDoS attacks, port scanning, SYN floods, or any activity intended to disrupt, degrade, or interfere with CloudNexus or third-party networks.
• Credential Harvesting: Operating phishing sites, fake login pages, or credential-stuffing infrastructure.
• Unauthorized Mining: Cryptocurrency mining or high-intensity computational workloads that exceed fair-use resource thresholds without prior written approval.
• IP/Domain Abuse: Using CloudNexus resources to facilitate proxy/VPN services that mask malicious activity, or hosting services that violate our partner network policies.

4. Resource Limits & Fair Use

Our infrastructure is shared at the network and hypervisor level. To ensure optimal performance for all customers, we enforce fair usage guidelines:

• Resources must be used efficiently. Sustained 100% CPU/RAM utilization over 72 hours may trigger a fair-use review.
• Bandwidth is provided according to your selected plan. Exceeding limits may result in throttling, overage charges, or upgrade requirements.
• Object storage and databases should not be used as long-term archival without appropriate lifecycle policies or backup-tier pricing.
• CloudNexus may implement temporary rate limits or resource caps to protect against runaway processes or configuration errors.

5. Content Compliance

Users are solely responsible for the content hosted on CloudNexus infrastructure. You must ensure compliance with all applicable content regulations, including:

• Copyright and intellectual property laws (DMCA, EUCD, etc.)
• Data privacy regulations (GDPR, CCPA, HIPAA where applicable)
• Age-restricted content hosting requirements and COPPA compliance
• Anti-hate speech and anti-discrimination policies where legally mandated

CloudNexus will cooperate with lawful takedown requests, DMCA notices, and law enforcement inquiries served through proper legal channels.

6. Security Responsibilities

CloudNexus operates on a shared responsibility model. While we secure the underlying infrastructure, you are responsible for:

• Implementing strong authentication (SSH keys, MFA, complex passwords)
• Keeping operating systems, dependencies, and applications patched
• Configuring firewalls, security groups, and network rules appropriately
• Encrypting sensitive data at rest and in transit
• Reporting vulnerabilities or compromised systems immediately to security@cloudnexus.com

CloudNexus may perform emergency security interventions if a customer system is actively compromising our network or other tenants.

7. Enforcement & Account Actions

CloudNexus monitors infrastructure usage through automated systems and manual reviews. Enforcement actions may include:

• Warning: Notification of policy violation with instructions to remediate
• Temporary Suspension: Isolation or suspension of the affected service while investigation occurs
• Termination: Permanent account closure and data removal for severe or repeated violations
• Refund Policy: Accounts terminated for AUP violations are not eligible for service credits or refunds

8. Policy Updates & Contact

CloudNexus may update this Acceptable Use Policy to reflect changes in technology, security threats, or legal requirements. Substantive changes will be communicated via email and dashboard notifications at least 30 days before taking effect. Continued use of our services constitutes acceptance of the updated policy.
