Important: By purchasing, using, or accessing Cup Source products and services, you acknowledge that you have read, understood, and agreed to the terms outlined in this Liability & Limitations policy. If you do not agree, please discontinue use and contact our customer support team.

1. Product Warranty & Quality Assurance

Cup Source guarantees that all products supplied are manufactured in compliance with applicable FDA, LFGB, and ISO food-contact safety standards. Our products are warranted to be free from material defects under normal use and storage conditions for a period of 90 days from the date of delivery.

This warranty does not cover damage resulting from improper storage, exposure to extreme temperatures, misuse, unauthorized modification, or use outside intended food/beverage service applications.

2. Limitation of Liability

To the fullest extent permitted by law, Cup Source’s total liability for any claim arising out of or related to the purchase, use, or inability to use our products shall not exceed the total amount paid by the buyer for the specific products giving rise to the claim.

In no event shall Cup Source be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of business, interruption of operations, or damage to brand reputation, regardless of the legal theory upon which the claim is based.

3. Intended Use & Regulatory Compliance

Our products are designed and intended for single-use or specified multi-use beverage and food service applications only. Cup Source is not liable for any injury, damage, or regulatory non-compliance resulting from:

4. Custom Printing & Branding

For custom-branded orders, Cup Source is responsible for producing prints according to the approved digital proof provided by the client. Minor color variations due to printing processes, paper stock, lighting conditions, or screen calibration are not considered defects.

Cup Source does not verify trademark, copyright, or intellectual property rights of artwork submitted by clients. The client assumes full responsibility for ensuring all submitted designs, logos, and copy comply with applicable intellectual property laws.

Buyer agrees to indemnify, defend, and hold harmless Cup Source, its officers, directors, employees, and affiliates from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or related to:

Cup Source shall not be liable for any failure or delay in performance due to circumstances beyond its reasonable control, including but not limited to natural disasters, pandemics, government restrictions, labor strikes, supply chain disruptions, raw material shortages, or acts of God. In such events, we will notify affected parties promptly and work to resume fulfillment as soon as reasonably possible.

7. Governing Law & Dispute Resolution

This policy shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising under this policy shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, held in Wilmington, DE.

8. Modifications to This Policy

Cup Source reserves the right to update, modify, or replace any part of this Liability & Limitations policy at any time. Changes will be effective immediately upon posting to our website. It is your responsibility to review this page periodically for updates.
