📜 1. Acceptance of Terms
By placing an order, requesting a quote, or engaging in commerce with Cup Source ("the Supplier"), you ("the Buyer") agree to be bound by these Terms of Service and the associated Incoterms. These terms govern all wholesale transactions for disposable drinkware, cups, bowls, and packaging solutions.
Any purchase order or contract sent by the Buyer containing terms inconsistent with these Terms shall be considered a counter-offer and must be expressly accepted in writing by Cup Source to be valid.
📦 2. Products & Pricing
All products listed on the Cup Source catalog are subject to availability. Specifications, including materials, dimensions, and certifications (FDA, LFGB, FSC), are provided in good faith but may be subject to minor manufacturing variances.
Pricing
- Pricing is quoted in USD unless otherwise specified.
- Wholesale pricing is tiered based on volume commitments.
- Prices are valid for 30 days from the date of quotation due to raw material fluctuations.
- Custom branding/printing may incur setup fees.
📝 3. Order Process
Orders become binding only upon written confirmation by Cup Source, including a Purchase Order (PO) number and Proforma Invoice (PI). Buyers are responsible for ensuring accurate specifications on their POs.
Order Modifications
Once production has commenced, modifications to order quantity or specifications may incur re-tooling fees. Cancellations after production start are subject to a minimum 50% charge.
💳 4. Payment Terms
Cup Source offers flexible payment structures based on creditworthiness and order value.

Late payments are subject to a finance charge of 1.5% per month or the maximum rate permitted by law, whichever is less.
🚚 5. Shipping & Delivery
Cup Source utilizes a global logistics network to ensure timely delivery. Shipping times are estimates and not guarantees unless explicitly agreed upon in a binding contract with premium expedited fees.
- Domestic (USA): 3–7 business days via standard carriers.
- International Ocean Freight: 25–45 days depending on destination port.
- Air Freight: 5–10 business days (available for urgent orders).
🌍 6. Incoterms 2020
Cup Source operates under the ICC Incoterms® 2020 rules. Selecting the correct Incoterm defines the allocation of costs and risks between Buyer and Seller. Unless otherwise stated, all quotes default to FOB (Free On Board).
Buyer bears all costs and risks involved in taking the goods from the Supplier's warehouse to the final destination. Minimum obligation for Cup Source.
Cup Source delivers goods on board the vessel nominated by the Buyer. Risk transfers once goods pass the ship's rail. Buyer handles main carriage and insurance.
Cup Source pays for costs, insurance, and freight to the destination port. Risk transfers to Buyer once goods are on the vessel, despite Seller paying freight.
Cup Source delivers to a named place. Seller bears all risks during transport. Buyer is responsible for import clearance and unloading.
Maximum obligation. Cup Source handles delivery, import duties, taxes, and customs clearance. Goods delivered ready for unloading at Buyer's door.
Flexible term. Cup Source delivers goods to a carrier nominated by the Buyer at a named location. Suitable for multi-modal transport.
↩️ 7. Returns & Defects
Buyers must inspect goods within 14 days of receipt. Claims for manufacturing defects, damage in transit, or non-conformance must be submitted in writing with photographic evidence.
- Defective Goods: Cup Source will replace or refund defective products at its discretion. Replacement production is prioritized.
- Custom Orders: Custom branded items are non-returnable unless a material defect exists, as they cannot be resold.
- Restocking Fee: Non-defective returns for change-of-order may be subject to a 20% restocking fee.
⚖️ 8. Limitation of Liability
To the maximum extent permitted by law, Cup Source's total liability shall not exceed the value of the specific order giving rise to the claim. Cup Source is not liable for indirect, consequential, or incidental damages, including lost profits or business interruption.
