DMCA Policy

FamilyNest respects the intellectual property rights of others and expects its users to do the same. This page outlines our procedures for handling copyright infringement notices.

1. Introduction

FamilyNest ("we," "our," or "us") operates as a parenting and family support platform that hosts user-generated content, educational resources, and community discussions. We are committed to respecting the intellectual property rights of all content creators and comply with the Digital Millennium Copyright Act (DMCA) and similar international copyright laws.

2. How to Submit a DMCA Takedown Notice

If you believe that content hosted or linked on FamilyNest infringes upon your copyright, you may submit a written notification to our designated DMCA agent. Please ensure your notice includes all required information outlined in Section 3 of this policy.

3. Required Information for DMCA Notices

To process your request efficiently and in compliance with the DMCA, your notification must include the following:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  • A description of the copyrighted work claimed to have been infringed.
  • A description of the infringing material and its location on our platform (including specific URLs).
  • Your contact information: address, telephone number, and email address.
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

4. Processing of DMCA Takedown Requests

Upon receipt of a valid DMCA takedown notice, FamilyNest will:

  1. Act expeditiously to remove or disable access to the allegedly infringing material.
  2. Notify the user who posted the content of the takedown request and provide a copy of your notice.
  3. Preserve records of the infringement notice and any related materials for at least 15 days, as required by law.

Please note that incomplete or invalid notices may delay processing. We reserve the right to reject notices that do not comply with DMCA requirements.

5. Counter-Notice Process

If you believe your content was removed or disabled in error or misidentified, you may submit a counter-notice to our DMCA agent. Your counter-notice must include:

  • Your name, address, telephone number, and email address.
  • Identification of the material that has been removed or disabled and its location.
  • A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification.
  • A statement that you consent to the jurisdiction of the federal court in which your address is located (or a relevant judicial district if outside the US) and that you will accept service of process from the person who provided the DMCA notice.

Upon receiving a valid counter-notice, we will forward it to the original complainant. Within 10–14 business days, we may restore the removed content unless the complainant informs us that they have filed a court action seeking a restraining order or other relief.

6. Repeat Infringer Policy

FamilyNest maintains a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. Users who receive multiple valid DMCA complaints may have their access restricted or permanently suspended without prior notice.

7. Limitation of Liability

FamilyNest acts solely as a service provider and platform for user-generated content. We do not host, control, or endorse all content posted by users. To the fullest extent permitted by law, FamilyNest shall not be liable for any copyright infringement committed by its users. This policy is provided for informational purposes and does not constitute legal advice.

8. Changes to This Policy

We may update this DMCA Policy from time to time to reflect changes in our practices, applicable laws, or platform features. Updates will be posted on this page with a revised "Last Updated" date. Continued use of FamilyNest following any changes constitutes acceptance of the updated policy.
