1. Acceptance of Terms

By accessing, browsing, or using the FamilyNest website, mobile application, and related services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Use. If you do not agree with any part of these terms, please discontinue use of the Platform immediately.

FamilyNest reserves the right to modify these terms at any time. Continued use of the Platform following the posting of changes constitutes acceptance of those changes. We will notify users of material changes via email or prominent notice on the Platform.

2. Eligibility & Account Creation

To create an account and access certain features of FamilyNest, you must be at least 13 years of age. If you are between 13 and 18, a parent or legal guardian must consent to your use of the Platform and be responsible for your activities.

You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate. You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must notify FamilyNest immediately of any unauthorized use.

3. User Content & Intellectual Property

3.1 Our Content

All content on FamilyNest, including text, graphics, logos, icons, images, audio clips, digital downloads, data compilations, software, and parenting resources, is the property of FamilyNest or its licensors and is protected by intellectual property laws. You may not reproduce, distribute, modify, or create derivative works without express written permission.

3.2 User-Generated Content

By posting content (reviews, forum posts, photos, videos, etc.), you grant FamilyNest a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, and distribute such content globally. You represent and warrant that you own or have the necessary rights to post such content and that it does not violate any third-party rights or these Terms.

4. Community Guidelines

FamilyNest fosters a supportive, respectful, and inclusive environment for families. Users may not:

• Post hate speech, harassment, discrimination, or threatening content
• Share personal information of minors or other users without consent
• Impersonate individuals, organizations, or official FamilyNest staff
• Post spam, malware, or unauthorized promotional material
• Share content that violates privacy laws or depicts harmful parenting practices

Violations may result in content removal, account suspension, or permanent termination at FamilyNest's sole discretion.

Your privacy is important to us. Our collection, use, and storage of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using FamilyNest, you consent to the data practices described in the Privacy Policy, including the use of cookies, analytics, and targeted communications.

We do not sell your personal information to third parties. Data may be shared with trusted service providers solely for operational purposes (e.g., hosting, payment processing, customer support) under strict confidentiality agreements.

To the fullest extent permitted by applicable law, FamilyNest, its founders, employees, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Platform
• Any conduct or content of any third party on the Platform
• Content obtained from the Platform
• Unauthorized access, use, or alteration of your transmissions or content

FamilyNest's total liability to you for any claim arising out of or related to these terms or your use of the Platform shall not exceed the amount you paid us, if any, in the twelve months prior to the claim.

8. Termination & Suspension

We may terminate or suspend your account and access to the Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Platform will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

9. Changes to These Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. By continuing to access or use our Platform after any revisions become effective, you agree to be bound by the revised terms.

10. Governing Law & Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions. Any disputes arising out of or relating to these Terms shall be resolved through binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in a mutually agreed jurisdiction, and judgment on the award may be entered in any court having jurisdiction.
