1. Scope of Services & No Guarantee of Results

Isdomain provides strategic consulting, creative naming, brand identity development, and legal basics guidance. While we employ industry best practices, rigorous research, and professional expertise, we do not guarantee specific business outcomes, commercial success, domain availability, trademark approval, or market reception. Branding and legal processes are subject to external factors, regulatory changes, and third-party decisions beyond our control.

2. Limitation of Direct Liability

Under no circumstances shall Isdomain, its founders, employees, contractors, or partners be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, revenue, data, or business opportunities
• Costs of procurement of substitute goods or services
• Business interruption, loss of goodwill, or brand reputation damage
• Any other intangible losses arising from the use of or reliance on our consulting services

Our total aggregate liability for any claim arising out of or related to our services shall not exceed the total amount actually paid by you to Isdomain for the specific service giving rise to the claim during the preceding twelve (12) months.

By engaging Isdomain, you acknowledge that:

• You will provide accurate, complete, and truthful business information
• You are responsible for final decisions regarding brand naming, visual identity, and legal filings
• You will secure all necessary government approvals, domain registrations, and intellectual property protections through official channels
• You will not use our deliverables for unlawful, fraudulent, or infringing purposes

7. Governing Law & Dispute Resolution

This Limitation of Liability shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from this clause shall be subject to binding arbitration in San Francisco, CA, in accordance with the rules of the American Arbitration Association. Isdomain reserves the right to seek injunctive relief in a court of competent jurisdiction.

8. Severability & Modifications

If any provision of this Limitation of Liability is deemed invalid, unenforceable, or contrary to applicable law, the remaining provisions shall remain in full force and effect. Continued use of our services following such modifications constitutes acceptance of the updated terms.
