1. Overview & Scope

JobSphere respects intellectual property rights and is committed to fostering an environment where innovation, creativity, and professional development thrive. This policy outlines our approach to copyright, trademarks, user-generated content, and procedures for addressing intellectual property (IP) concerns.

By accessing or using JobSphere, you acknowledge and agree to comply with this Intellectual Property Policy alongside our Terms of Service and Privacy Policy.

4. User-Generated Content & Ownership

JobSphere allows users to upload resumes, portfolios, company logos, and job descriptions. Users retain ownership of their original content but grant JobSphere a limited, non-exclusive, royalty-free license to host, display, process, and distribute such content solely for platform functionality, matching, and security purposes.

Key Principles:

  • You represent that you hold all necessary rights to upload submitted content
  • Content must not infringe on third-party copyrights, trademarks, or privacy rights
  • JobSphere reserves the right to remove content that violates this policy or applicable laws
  • Employers granting JobSphere access to ATS data do so under separate data processing agreements

5. DMCA & Takedown Procedures

In compliance with the Digital Millennium Copyright Act (DMCA) and equivalent international frameworks, JobSphere provides a structured process for addressing claims of copyright infringement. We take all valid takedown notices seriously and will promptly investigate and act upon verified claims.

How the Process Works:

  1. Submission: Rights holders submit a formal DMCA notice via our designated portal or email
  2. Review: Our legal team verifies the notice against statutory requirements
  3. Action: Valid claims result in immediate content removal or access restriction
  4. Notification: The reported user is notified with an opportunity to file a counter-notification
  5. Resolution: Content may be restored following legal evaluation of counter-notices

Repeated infringers may face account suspension or permanent termination in accordance with our repeat infringer policy.

6. Reporting Intellectual Property Infringement

If you believe your intellectual property has been infringed upon through the JobSphere platform, please submit a detailed report. Include:

  • Description of the copyrighted or trademarked work
  • Direct URL(s) to the allegedly infringing material
  • Your contact information and statement of good faith belief
  • Physical or electronic signature of the rights holder or authorized agent

Reports are reviewed within 3-5 business days. Fraudulent or bad-faith takedown requests may result in legal liability under DMCA Section 512(f).
