1. Introduction & Acceptance

By accessing, browsing, or using our website, mobile application, and associated wellness services (collectively, the "Platform"), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions ("Terms"). These Terms constitute a legally binding agreement between you and SereneMind Inc. ("Company", "we", "us", or "our").

If you do not agree to these Terms, you must immediately discontinue use of the Platform. Continued use following any updates to these Terms constitutes your acceptance of the revised agreement.

  • "Content" means all text, graphics, audio, video, software, and proprietary materials provided on the Platform.
  • "Therapist" refers to licensed mental health professionals contracted or employed by SereneMind to provide supportive services.

3. Eligibility & Account Security

You must be at least 18 years of age to create an account and access paid Services. By using the Platform, you represent and warrant that you meet this requirement. You are solely responsible for maintaining the confidentiality of your login credentials and for all activities occurring under your account. You agree to notify us immediately of any unauthorized access or security breach.

4. Scope of Services

Our Services are not intended to diagnose, treat, cure, or prevent any medical or mental health condition. They do not replace professional medical advice, diagnosis, or treatment. While we strive to match you with qualified therapists and provide evidence-based mindfulness tools, outcomes vary by individual. SereneMind does not guarantee specific therapeutic results or symptom resolution.

5. User Conduct

You agree to use the Platform responsibly and in compliance with all applicable laws. Prohibited conduct includes, but is not limited to:

  • Posting harmful, abusive, or discriminatory content
  • Misrepresenting your identity or providing false information
  • Attempting to reverse-engineer, hack, or disrupt Platform security
  • Using automated bots or scrapers to access Services
  • Harassing therapists, staff, or other users

We reserve the right to suspend or terminate accounts violating these guidelines without prior notice.

6. Privacy & Data Protection

Your privacy is paramount. Our collection, use, and storage of personal and health-related data are governed by our Privacy Policy, which is incorporated into these Terms by reference. We employ industry-standard encryption, access controls, and compliance measures (including HIPAA considerations where applicable) to protect your information. By using the Platform, you consent to our data practices as outlined therein.

7. Intellectual Property

All Content, trademarks, logos, and proprietary technology on the Platform are the exclusive property of SereneMind and its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Content solely for personal, non-commercial purposes. 8. Subscription & Billing

Certain Services require a paid subscription. Pricing, features, and billing cycles are detailed at checkout. Subscriptions auto-renew unless canceled prior to the renewal date. Refunds are issued in accordance with our Refund Policy. We reserve the right to adjust pricing with 30 days' prior notice, which will not affect active subscription periods.

9. Limitation of Liability

To the maximum extent permitted by law, SereneMind and its directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, profit, or emotional distress, arising from your use of or inability to use the Platform. Our total liability shall not exceed the amount paid by you in the preceding 12 months.

10. Termination

You may terminate your account at any time via account settings or by contacting support. We may terminate or suspend access immediately for breaches of these Terms, fraudulent activity, or prolonged inactivity. Upon termination, your right to access Services ceases immediately, and we may delete your account data in accordance with our retention policy.

11. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in accordance with AAA rules, conducted individually in San Francisco, CA. Class action waivers apply where legally permissible.
