Last Updated: January 15, 2025

01 Acceptance of Terms

By accessing, using, or registering for any services provided by Sitemap.xml ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use our services. We reserve the right to modify these Terms at any time, and your continued use of our services following such modifications constitutes your acceptance of the updated Terms.

02 Description of Services

Sitemap.xml provides a suite of web discovery and indexing optimization tools, including but not limited to:

  • Automated XML, HTML, and JSON sitemap generation
  • Real-time search engine indexing APIs and submission pipelines
  • Crawl analytics, coverage monitoring, and SEO performance dashboards
  • Integrations with popular CMS platforms and headless architectures

Our services are provided on an "as-is" and "as-available" basis, subject to applicable service level agreements (SLAs) for paid subscription tiers.

03 User Accounts

To access certain features, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You agree to provide accurate, current, and complete information during registration and to update such information as needed. If you discover any unauthorized use of your account, you must notify us immediately at security@sitemap.xml.

04 Acceptable Use Policy

You agree not to use our services to:

  • Violate any applicable laws, regulations, or third-party rights
  • Crawl, scrape, or index websites without proper authorization
  • Submit malicious, fraudulent, or spam URLs to search engines
  • Reverse engineer, decompile, or attempt to extract source code from our software
  • Exceed rate limits or abuse API endpoints in a manner that degrades service for others

We reserve the right to suspend or terminate accounts that violate this policy.

05 Intellectual Property

All content, features, functionality, software, trademarks, and service names related to Sitemap.xml are the exclusive property of Sitemap.xml and its licensors. These materials are protected by intellectual property laws and international treaties. You are granted a limited, non-exclusive, non-transferable, revocable license to use our services solely for your internal business purposes in accordance with these Terms.

Data Ownership: You retain all rights to your website URLs, sitemap data, and analytics reports generated through our platform. We may anonymize and aggregate usage data to improve our services.

06 Data & Privacy

Your privacy is important to us. Our collection, processing, and storage of personal data is governed by our Privacy Policy, which is incorporated into these Terms by reference. We utilize industry-standard encryption, access controls, and security protocols to protect your data. By using our services, you consent to our data practices as outlined in the Privacy Policy.

07 Service Limitations

While we strive for high availability, we do not guarantee uninterrupted, error-free, or secure service. Search engine crawling and indexing are ultimately controlled by third parties (e.g., Google, Bing, Yandex). Sitemap.xml facilitates the technical process but cannot guarantee indexing outcomes, ranking improvements, or specific traffic results.

08 Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason whatsoever, including if you breach these Terms. Upon termination, your right to use the services will cease immediately. You are responsible for exporting your data prior to account termination.

09 Limitation of Liability

To the maximum extent permitted by applicable law, Sitemap.xml and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, goodwill, or other intangible losses, resulting from your access to or use of (or inability to access or use) the services.

10 Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

11 Modifications to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your continued use of the services after any such changes constitutes your acceptance of the new Terms.
