Governing Law & Jurisdiction

1. Governing Law

All agreements, bookings, waivers, terms of service, privacy policies, and any other legal documents published by or on behalf of SummitX Adventures LLC ("Company," "we," "our," or "us") shall be governed by and construed in accordance with the laws of the State of Colorado, United States of America, without regard to its conflict of law principles.

This governing law applies to all domestic and international adventures, regardless of the participant's country of residence or the physical location where the expedition takes place.

2. Jurisdiction & Venue

Any legal suit, action, or proceeding arising out of or related to your use of our services, website, bookings, or participation in any SummitX adventure shall be exclusive jurisdiction and venue in the state or federal courts located in Denver, Colorado, United States.

By accessing our website, making a reservation, or participating in any guided activity, you explicitly consent to the personal jurisdiction of these courts and waive any objection to venue or forum non conveniens.

3. Dispute Resolution

SummitX Adventures is committed to resolving any disputes fairly and efficiently. In the event of a disagreement:

• Direct Negotiation: We encourage parties to first attempt to resolve the matter directly through our Customer Support or Legal Compliance teams.
• Mediation: If negotiation fails, both parties agree to participate in good-faith mediation administered by the American Arbitration Association (AAA) before pursuing litigation.
• Binding Arbitration: Unless otherwise prohibited by applicable law, any unresolved dispute shall be settled by binding arbitration in accordance with AAA Commercial Arbitration Rules.

4. Class Action Waiver & Waiver of Jury Trial

By engaging with SummitX Adventures, you agree to waive your right to participate in any class action lawsuit, consolidated lawsuit, or representative proceeding related to your experience with us. Additionally, you expressly waive your right to a jury trial in any individual dispute, mediation, arbitration, or litigation.

5. Severability

If any provision of this Governing Law policy or any related SummitX legal document is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be severed, and the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

6. Amendments & Updates

SummitX Adventures reserves the right to modify, update, or replace this Governing Law policy at any time to reflect changes in applicable legislation, corporate structure, or operational practices. Material changes will be posted on this page with an updated "Last Updated" date. Continued use of our services following such updates constitutes acceptance of the revised terms.

7. International Participants

Participants residing outside the United States are responsible for understanding and complying with both the governing law stated herein and any applicable local laws regarding adventure tourism, liability waivers, and dispute resolution. This does not diminish SummitX's commitment to safety, transparency, and ethical outdoor practices worldwide.
