1. Acceptance of Terms
By booking, purchasing, or participating in any SummitX Adventures expedition, tour, workshop, or related service (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to all terms and conditions outlined herein, you must not participate in our Services.
These terms apply to all participants aged 18 and older. Minors must be accompanied by a legal guardian who accepts these terms on their behalf.
2. Bookings & Payments
2.1 Reservation Requirements
All bookings require a valid email address, full legal name, emergency contact information, and completion of our digital waiver form prior to departure.
2.2 Payment Schedule
Upon booking, a non-refundable deposit of 30% of the total trip cost is required to secure your reservation. The remaining balance is due 45 days prior to the departure date. Failure to pay the balance by the due date may result in automatic cancellation of the reservation.
2.3 Accepted Payment Methods
We accept major credit cards, debit cards, and approved bank transfers. All prices are listed in USD unless otherwise stated.
3. Cancellation & Refunds
β’ 45+ days before departure: Full refund minus deposit
β’ 30β44 days before departure: 50% refund
β’ 15β29 days before departure: 25% refund
β’ Less than 15 days before departure: No refund
β’ No-show: No refund and no credit issued
Refund requests must be submitted in writing to our support team. Processing may take 7β14 business days. Trip insurance is strongly recommended and can be purchased at checkout through our third-party partner.
4. Safety & Assumption of Risk
4.1 Inherent Risks
Outdoor adventure activities carry inherent risks, including but not limited to injury, illness, equipment failure, wildlife encounters, adverse weather, and terrain hazards. By participating, you acknowledge and voluntarily assume these risks.
4.2 Fitness & Preparation
Participants must meet the physical and skill requirements specified for each expedition. False representation of fitness level, experience, or medical conditions may result in removal from the trip without refund.
4.3 Guide Authority
Lead guides and safety officers have final authority over route selection, pace, safety protocols, and emergency decisions. Participants must follow all instructions immediately. Disobedience may result in immediate dismissal.
5. Code of Conduct
SummitX Adventures is committed to fostering a respectful, sustainable, and inclusive environment. Participants agree to:
- Follow the Leave No Trace principles and respect all ecosystems and wildlife.
- Refrain from harassment, discrimination, threats, or abusive behavior toward staff or fellow participants.
- Avoid possession or use of illegal substances, firearms, or unauthorized equipment.
- Respect local customs, regulations, and private property at all destinations.
Violation of this code may result in immediate removal from the expedition, forfeiture of fees, and permanent banning from future bookings.
6. Force Majeure
SummitX Adventures is not liable for delays, cancellations, or modifications caused by events beyond our reasonable control, including but not limited to:
- Natural disasters, extreme weather, or environmental hazards
- Political instability, civil unrest, or travel restrictions
- Pandemics, epidemics, or public health emergencies
- Transportation strikes, airline cancellations, or border closures
In the event of force majeure, we will work to provide alternative dates, partial refunds, or trip credits based on circumstances. We strongly recommend purchasing comprehensive travel insurance.
7. Limitation of Liability & Indemnification
To the fullest extent permitted by law, SummitX Adventures, its officers, employees, guides, contractors, and affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising from your participation in our Services.
By booking, you agree to indemnify and hold harmless SummitX Adventures from any claims, losses, injuries, or damages arising from your actions, negligence, or violation of these terms.
8. Media & Intellectual Property
During expeditions, SummitX Adventures may capture photographs, videos, audio recordings, and written content featuring participants. By joining a trip, you grant SummitX Adventures a non-exclusive, royalty-free license to use such media for marketing, educational, and promotional purposes across all platforms.
If you prefer not to be featured in any media, please notify our operations team in writing at least 14 days prior to departure. We cannot guarantee complete exclusion in group settings.
All trip itineraries, guide materials, branded content, and website assets remain the exclusive intellectual property of SummitX Adventures and may not be reproduced without written permission.
9. Privacy Policy
Your personal information is collected and processed in accordance with our Privacy Policy. We collect data necessary for booking, safety compliance, emergency response, and service improvement. We do not sell or share personal data with third parties except as required for trip fulfillment or legal compliance.
10. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to its conflict of law principles.
Any disputes arising from these terms or your participation in our Services shall first be resolved through good-faith negotiation. If unresolved, disputes shall be settled through binding arbitration in Denver, Colorado, in accordance with the rules of the American Arbitration Association.
