Liability Waiver & Consent

RELEASE, WAIVER OF LIABILITY, ASSUMPTION OF RISK, AND INDEMNITY AGREEMENT

WHEREAS, SummitX Adventures ("SummitX", "Company", "we", "us", or "our") provides outdoor adventure experiences, including but not limited to trekking, climbing, rafting, camping, and guided expeditions (collectively, the "Activities"); and

WHEREAS, the undersigned participant ("Participant", "I", or "me") wishes to participate in the Activities organized by SummitX;

1. ASSUMPTION OF RISK

I acknowledge that outdoor adventure activities involve inherent risks, including but not limited to: physical injury, illness, equipment failure, weather-related hazards, wildlife encounters, altitude sickness, falls, drowning, and death. I voluntarily assume all known and unknown risks associated with participation.

2. RELEASE OF LIABILITY

IN CONSIDERATION of being permitted to participate in the Activities, I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE SummitX Adventures, its officers, directors, employees, agents, affiliates, and successors from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, while participating in the Activities.

3. MEDICAL CONSENT

I grant permission for SummitX Adventures and its designated personnel to obtain emergency medical or hospital care on my behalf in the event of injury or illness during the Activities. I agree to bear all costs associated with such care.

4. INDEMNIFICATION

I agree to INDEMNIFY AND HOLD HARMLESS SummitX Adventures from any and all claims, losses, damages, or expenses (including legal fees) arising out of my participation or negligence.

5. PHOTOGRAPHY & MEDIA

I grant SummitX Adventures the right to use any photographs, videos, or recordings taken during the Activities for promotional, educational, or documentary purposes, without compensation.

6. GOVERNING LAW

This Agreement shall be governed by the laws of the jurisdiction in which SummitX Adventures is incorporated. Any disputes shall be resolved through binding arbitration.

7. MINORS

If the Participant is a minor, the parent or legal guardian signing this Agreement does so on behalf of the minor and assumes all responsibilities outlined herein.

BY SIGNING BELOW, I ACKNOWLEDGE THAT I HAVE READ THIS AGREEMENT, UNDERSTAND ITS TERMS, AND AGREE TO BE BOUND BY THEM. I UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL LEGAL RIGHTS.
