10.4 Effects of Termination
This section outlines the immediate and subsequent effects of employment termination for all employees, contractors, and affiliated personnel of That Is A Q. Termination may occur voluntarily, involuntarily, or by mutual agreement, and all outlined procedures apply unless otherwise specified by applicable law or contractual obligation.
Immediate Effects
Upon effective date of termination, the following actions are executed immediately:
- Employment status is formally updated in all internal HRIS and payroll systems.
- Access to company networks, email accounts, cloud platforms, and physical premises is revoked.
- Employment verification records are updated to reflect the termination date and classification.
Final compensation must be issued in compliance with state and local wage laws. Delays in final payment may result in administrative penalties and are strictly prohibited.
Financial & Compensation Impact
Termination triggers specific financial adjustments outlined below:
| Compensation Component | Effect of Termination | Timeline |
|---|---|---|
| Base Salary / Hourly Wages | Paid through final worked day | Per statutory deadline |
| Accrued PTO | Outstanding balance paid out (where required by law) | With final paycheck |
| Equity / Vesting | Unvested shares/options forfeited per equity agreement | Immediate upon effective date |
| Bonuses / Commissions | Evaluated based on performance period and plan terms | Per scheduled payout cycle |
Employees are advised to review their individual compensation agreements, as plan-specific terms may modify standard payout schedules.
Benefits & Insurance Continuation
Coverage termination and continuation options are governed by federal and state regulations:
- Health Insurance: Coverage typically ends on the last day of the termination month. COBRA continuation eligibility notices will be issued within 14 days.
- Dental & Vision: Follows the same termination timeline as primary health insurance.
- Retirement Plans (401k/403b): Account balances remain intact. Rollover or distribution options are provided by the plan administrator.
- Life & Disability: Coverage terminates per policy terms. Conversion options may be available for a limited window.
HR Benefits specialists will provide personalized summary packets detailing continuation rights, deadlines, and enrollment procedures.
Company Property & Access Revocation
All company-owned assets must be returned or securely transitioned before departure:
- Hardware (laptops, phones, monitors, access cards)
- Software licenses, developer keys, and administrative credentials
- Physical documents, proprietary research, and client data
- Vehicle, parking passes, or other logistical assets
Failure to return company property may result in deduction from final compensation where legally permissible, or separate recovery action. IT Security will formally deactivate all digital identities within 24 hours of the effective date.
Legal & Compliance Obligations
Post-termination, the following obligations remain in force:
- Confidentiality: NDAs and data protection agreements survive termination indefinitely.
- Non-Compete / Non-Solicit: Enforceable only where permitted by jurisdictional law and explicitly agreed upon.
- IP Assignment: All work product, code, designs, and intellectual property developed during employment remain the sole property of That Is A Q.
- Record Retention: Employees must not destroy, alter, or remove company records regardless of termination reason.
Violation of post-termination legal obligations may result in civil liability, injunctions, or criminal prosecution depending on severity and jurisdiction.
Post-Termination Communications
That Is A Q maintains a professional approach to post-employment relations:
- Former employees may be listed as alumni in internal directories (opt-in/opt-out available).
- Reference requests will be processed through HR, focusing on verified employment dates, titles, and responsibilities.
- Rehire eligibility is documented and reviewed on a case-by-case basis.
- Alumni networks, referral bonuses, and community events remain accessible unless restricted.
Exceptions & Special Cases
Standard termination effects may be modified in the following scenarios:
- Collective Bargaining Agreements: Union-represented roles follow contractually defined severance and transition terms.
- Executive Leadership: Employment agreements may include enhanced severance, consulting periods, or equity acceleration.
- Contractors & Vendors: Governed by independent contractor agreements; benefits and termination clauses differ materially.
- Legal Disputes / Litigation Holds: Document preservation and access restrictions may extend beyond standard revocation timelines.
Effective Date & Acknowledgment
This policy is effective as of January 1, 2025, and supersedes all prior versions. Amendments require written approval from the Chief Human Resources Officer and General Counsel. Continued employment constitutes acknowledgment of receipt and understanding of these terms.
