1. Scope of Services & Limitation of Liability
TimberCraft Pro ("Contractor") provides carpentry, woodworking, and structural contracting services as explicitly outlined in the executed project agreement. The Contractor's liability is strictly limited to the direct cost of repairs, replacements, or rework of workmanship that fails to meet industry standards and the specifications agreed upon in writing.
In no event shall TimberCraft Pro be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, commercial interruption, or aesthetic dissatisfaction not arising from material defects in craftsmanship.
⚠️ Note: Liability caps apply per project contract. Maximum recovery is limited to the total contract value unless otherwise stated in writing.
2. Indemnification Agreement
The Client agrees to indemnify, defend, and hold harmless TimberCraft Pro, its officers, employees, agents, and subcontractors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Pre-existing structural conditions, hidden defects, or site hazards not disclosed by the Client prior to contract execution.
- Client-directed modifications, unauthorized work, or use of Contractor-supplied materials for purposes other than the agreed scope.
- Third-party actions, municipal code changes, or permitting delays initiated after contract signing.
- Damage caused by the Client, their guests, contractors, or pets during active project hours.
This indemnification obligation survives project completion and the final warranty period.
3. Insurance Coverage
TimberCraft Pro maintains comprehensive insurance coverage to protect both the Contractor and the Client during project execution:
- General Liability Insurance: $2,000,000 per occurrence / $4,000,000 aggregate
- Workers' Compensation: State-mandated coverage for all employees and subcontractors
- Commercial Auto & Equipment: Full coverage for transportation of materials and tools
- Care, Custody & Control: Up to $50,000 for on-site material protection
Clients are encouraged to verify coverage certificates upon request. TimberCraft Pro reserves the right to require proof of Client homeowner's or property insurance prior to site access.
4. Warranty vs. Liability
TimberCraft Pro provides a 5-Year Workmanship Warranty on all custom carpentry, cabinetry, and structural framing. This warranty covers defects in materials and labor under normal use and environmental conditions. It does not cover:
- Natural wear, fading, or seasonal wood movement
- Damage from moisture intrusion, pests, or improper maintenance
- Modifications made by unauthorized parties
- Finish variations inherent to natural wood grain
Warranty claims must be submitted in writing within 30 days of defect discovery. Liability for breach of contract is separate from and in addition to warranty provisions.
5. Unforeseen Site Conditions
Carpentry and renovation projects frequently reveal hidden conditions (e.g., outdated electrical, concealed rot, asbestos, structural discrepancies) that were not detectable during initial consultation. In such cases:
- Work will pause until the Client is notified and approves a change order.
- Additional costs and timeline adjustments will be documented in writing.
- TimberCraft Pro assumes no liability for delays or expenses resulting from undisclosed site conditions.
6. Client Responsibilities & Site Access
To ensure safe and efficient project completion, Clients must:
- Provide clear, safe access to the work area at all agreed hours.
- Relocate valuables, fragile items, and personal belongings from the workspace.
- Ensure utilities (water, electricity, HVAC) are operational unless otherwise arranged.
- Obtain necessary neighborhood or HOA approvals prior to project start.
Failure to meet these responsibilities may result in work suspension without penalty to TimberCraft Pro.
7. Dispute Resolution & Governing Law
All disputes arising from this policy or project contracts shall first be addressed through good-faith negotiation between the Client and TimberCraft Pro management. If unresolved within 30 days, parties agree to mediation through a neutral third party before pursuing litigation.
This policy and all related contracts are governed by the laws of the State of Illinois. Any legal proceedings shall be conducted exclusively in the county where the project is located.
This document serves as a general policy overview. Specific terms will be detailed in the signed project agreement, which supersedes general statements where conflicts arise.
8. Acknowledgment & Contact
By signing any TimberCraft Pro project agreement, the Client acknowledges reading, understanding, and accepting the terms outlined in this Liability & Indemnification Policy. Updates to this policy will be communicated via email and posted on this page.
