Liability & Indemnification Policy

Legal terms, insurance coverage, and client responsibilities governing all TimberCraft Pro contracting engagements.

1. Scope of Services & Limitation of Liability

TimberCraft Pro ("Contractor") provides carpentry, woodworking, and structural contracting services as explicitly outlined in the executed project agreement. The Contractor's liability is strictly limited to the direct cost of repairs, replacements, or rework of workmanship that fails to meet industry standards and the specifications agreed upon in writing.

In no event shall TimberCraft Pro be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of use, commercial interruption, or aesthetic dissatisfaction not arising from material defects in craftsmanship.

⚠️ Note: Liability caps apply per project contract. Maximum recovery is limited to the total contract value unless otherwise stated in writing.

2. Indemnification Agreement

The Client agrees to indemnify, defend, and hold harmless TimberCraft Pro, its officers, employees, agents, and subcontractors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

3. Insurance Coverage

TimberCraft Pro maintains comprehensive insurance coverage to protect both the Contractor and the Client during project execution:

Clients are encouraged to verify coverage certificates upon request. TimberCraft Pro reserves the right to require proof of Client homeowner's or property insurance prior to site access.

4. Warranty vs. Liability

TimberCraft Pro provides a 5-Year Workmanship Warranty on all custom carpentry, cabinetry, and structural framing. This warranty covers defects in materials and labor under normal use and environmental conditions. It does not cover:

Warranty claims must be submitted in writing within 30 days of defect discovery. Liability for breach of contract is separate from and in addition to warranty provisions.

Carpentry and renovation projects frequently reveal hidden conditions (e.g., outdated electrical, concealed rot, asbestos, structural discrepancies) that were not detectable during initial consultation. In such cases:

7. Dispute Resolution & Governing Law

All disputes arising from this policy or project contracts shall first be addressed through good-faith negotiation between the Client and TimberCraft Pro management. If unresolved within 30 days, parties agree to mediation through a neutral third party before pursuing litigation.

This policy and all related contracts are governed by the laws of the State of Illinois. Any legal proceedings shall be conducted exclusively in the county where the project is located.

8. Acknowledgment & Contact

By signing any TimberCraft Pro project agreement, the Client acknowledges reading, understanding, and accepting the terms outlined in this Liability & Indemnification Policy. Updates to this policy will be communicated via email and posted on this page.
