Please read these Terms and Conditions carefully. By accessing or using BrightMinds Tutoring’s website, mobile applications, tutoring sessions, and related services (collectively, the "Services"), you agree to be bound by these terms. If you do not agree, please do not use our Services.

1. Acceptance of Terms

By creating an account, scheduling a session, making a purchase, or otherwise accessing the BrightMinds platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms and Conditions, our Privacy Policy, and any additional guidelines presented during registration or service delivery.

These terms constitute a legally binding agreement between you (the "User") and BrightMinds Tutoring, Inc. ("Company", "we", "us", or "our").

2. Description of Services

BrightMinds Tutoring provides online and hybrid educational support, including but not limited to:

  • One-on-one and small-group tutoring across academic subjects
  • Standardized test preparation (SAT, ACT, AP, GRE, etc.)
  • Access to proprietary study materials, practice exams, and progress tracking tools
  • Virtual classroom technology for live instruction
  • Administrative support, scheduling, and account management

Services are delivered by independent contractors and vetted educational professionals. We reserve the right to modify, suspend, or discontinue any part of the Services at our sole discretion.

3. Eligibility & Account Creation

You must be at least 13 years of age to create an account. Users under 18 must have a parent or legal guardian co-sign and assume responsibility for all account activities and payments. For users under 13, a parent/guardian must create and manage the account on their behalf.

You agree to provide accurate, current, and complete registration information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Payment, Billing & Refunds

All fees are displayed prior to purchase. By proceeding with checkout, you authorize BrightMinds to charge your selected payment method. Prices are in USD unless otherwise stated and may be subject to applicable taxes.

  • Subscriptions: Billed automatically on the renewal date. Cancellations must be made at least 48 hours before the billing cycle ends to avoid charges.
  • Pay-Per-Session: Charged at time of booking or completion, per plan terms.
  • Refunds: Unused session credits may be refunded within 30 days of purchase. No refunds are issued for sessions attended, partially attended, or cancelled less than 24 hours in advance.

Recurring payments may be managed in your Account Settings. Failure to provide updated payment information may result in service interruption.

5. Privacy & Data Protection

Your use of the Services is also governed by our Privacy Policy. By accepting these Terms, you consent to the collection, processing, and storage of personal information as described therein, including student performance data, communication logs, and payment details, for service delivery, improvement, and legal compliance.

6. Intellectual Property

All content, materials, software, branding, curriculum, lesson plans, and platform technology provided by BrightMinds are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. You may not copy, distribute, modify, or create derivative works from our materials without explicit written permission.

You retain ownership of your personal work and submissions. By sharing work in tutoring sessions, you grant BrightMinds a non-exclusive license to use it for instructional feedback and internal improvement purposes only.

7. User Conduct & Responsibilities

You agree to use the Services responsibly and ethically. Prohibited conduct includes:

  • Harassment, discrimination, or abusive behavior toward tutors or other users
  • Plagiarism, cheating, or misrepresentation of academic work
  • Unauthorized recording or distribution of session content
  • Using the platform for commercial purposes without authorization
  • Circumventing payment systems or security measures

We reserve the right to monitor sessions (where legally permissible and disclosed) for quality assurance and safety. Violations may result in warning, suspension, or permanent termination.

8. Limitation of Liability & Disclaimers

The Services are provided "as is" and "as available." While we strive for educational excellence, BrightMinds does not guarantee specific academic outcomes, grade improvements, or test scores. Results depend on individual effort, consistency, and prior knowledge.

To the maximum extent permitted by law, BrightMinds, its tutors, affiliates, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, income, or educational opportunities, arising from your use or inability to use the Services.

Important: Educational tutoring supplements but does not replace professional academic counseling, psychological services, or institutional guidance. Always consult school administrators for official academic planning.

9. Termination

You may terminate your account at any time via Account Settings or by contacting support. Upon termination, access to active services will cease, and any prepaid, unused credits may be refunded per Section 4.

BrightMinds may suspend or terminate your account immediately, without notice, for violations of these Terms, suspected fraud, or prolonged inactivity. Sections on payment, intellectual property, limitation of liability, and governing law shall survive termination.

10. Governing Law & Dispute Resolution

These Terms shall be governed by the laws of the State of California, without regard to conflict of law principles. Any disputes arising from these Terms or the Services shall first be subject to good-faith negotiation. If unresolved within 30 days, disputes shall be resolved through binding arbitration in San Francisco, CA, in accordance with AAA rules. Class actions are waived.

11. Changes to Terms

We may update these Terms to reflect service improvements, legal requirements, or policy changes. Material changes will be communicated via email or platform notification. Continued use after the effective date constitutes acceptance of revised terms. The "Last Updated" date at the top of this page indicates the current version.
