1. Acceptance of Terms
By accessing or using FlowCMS (the "Service"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you must not access or use the Service.
FlowCMS reserves the right to modify these Terms at any time. Continued use of the Service following the posting of changes constitutes your acceptance of those changes. We will notify users of material changes via email or through prominent notice on the platform.
2. Definitions
- "Platform" refers to the FlowCMS web application, API, SDKs, and related tools.
- "User" means any individual or entity that registers for and accesses the Service.
- "Content" means all text, media, data, APIs, and other materials created, uploaded, or managed by Users on the Platform.
- "Subscription" refers to paid plans that grant access to premium features and usage tiers.
- "Free Tier" refers to the basic, no-cost access level with usage limitations.
3. Accounts & Security
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
You are responsible for safeguarding your account credentials and for all activities that occur under your account. You must immediately notify FlowCMS of any unauthorized use or security breach. FlowCMS is not liable for losses resulting from your failure to maintain account security.
Note: Account sharing is prohibited unless explicitly allowed under your team or enterprise plan. Violation may result in account suspension.
4. Service Description
FlowCMS provides a cloud-based content management and delivery platform. Services may include but are not limited to: headless CMS APIs, visual page builders, content modeling, media management, multi-language support, AI-assisted workflows, and real-time collaboration tools.
FlowCMS operates on a cloud infrastructure and does not guarantee 100% uptime, though we strive for 99.9% availability as outlined in our SLA. Scheduled maintenance will be communicated at least 48 hours in advance. Unplanned outages will be addressed promptly with status updates provided via our status page.
5. Acceptable Use Policy
You agree not to use the Service to:
- Violate any applicable local, state, national, or international law or regulation
- Transmit malware, conduct DDoS attacks, or engage in unauthorized system access
- Host or distribute illegal, infringing, defamatory, or harmful content
- Scrape, reverse-engineer, or attempt to extract underlying code or APIs
- Use the Service for spam, phishing, or fraudulent activities
- Exceed rate limits or usage quotas associated with your plan
FlowCMS reserves the right to suspend or terminate access for violations of this policy, with or without prior notice.
6. Intellectual Property
The FlowCMS platform, including its software, design, logos, trademarks, and documentation, is the exclusive property of FlowCMS Inc. and is protected by copyright, trademark, and other intellectual property laws.
These Terms grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for your internal business purposes. You may not copy, modify, distribute, or create derivative works of the platform without explicit written permission.
7. User Content & Data
You retain all ownership rights to the content you create, upload, or manage through FlowCMS. By using the Service, you grant FlowCMS a limited, non-exclusive, worldwide license to store, process, transmit, and display your Content solely to provide and improve the Service.
You represent and warrant that you have all necessary rights, permissions, and licenses for any Content you upload. FlowCMS does not endorse, monitor, or control User Content, though we reserve the right to remove content that violates these Terms or applicable laws.
Upon termination, you may export your Content via our API or dashboard tools. FlowCMS will securely delete your data within 30 days of account closure, except where retention is required by law.
8. Pricing & Payment
Pricing for paid Subscriptions is displayed on our pricing page and may be updated with 30 days' notice. All fees are non-refundable except as expressly stated or required by law.
Payments are processed securely via authorized payment processors. You are responsible for providing valid payment information. Failed payments or insufficient funds may result in temporary suspension of premium features until payment is resolved.
Overshoot beyond plan limits will be billed at prorated overage rates. Enterprise customers may negotiate custom pricing and volume discounts.
9. Term & Termination
These Terms remain in effect while you use the Service. You may terminate your account at any time via your dashboard settings. FlowCMS may terminate or suspend your access immediately, without prior notice or liability, for breach of these Terms, fraudulent activity, or prolonged inactivity (over 12 months on Free Tier).
Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination (including intellectual property, indemnification, and limitation of liability) will remain in effect.
10. Limitation of Liability
To the fullest extent permitted by law, FlowCMS and its affiliates, directors, employees, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, use, or business interruption, arising from your use of or inability to use the Service.
Our total cumulative liability shall not exceed the total amount paid by you to FlowCMS in the 12 months preceding the claim. Some jurisdictions do not allow exclusions or limitations of liability, so these provisions may not apply to you.
11. Indemnification
You agree to indemnify, defend, and hold harmless FlowCMS and its related entities from any claims, damages, obligations, losses, liabilities, costs, and expenses arising from: (a) your violation of these Terms, (b) your Content or use of the Service, or (c) your breach of any third-party rights or applicable laws.
12. Privacy & Data Protection
Your privacy is important to us. Our processing of personal data is governed by our Privacy Policy, which incorporates by reference into these Terms. We comply with GDPR, CCPA, and other applicable data protection regulations.
FlowCMS implements industry-standard security measures including encryption in transit and at rest, regular penetration testing, and strict access controls. We may use sub-processors for hosting, analytics, and support, all bound by data processing agreements.
13. Changes to Terms
We may update these Terms periodically to reflect product changes, legal requirements, or business needs. Material changes will be communicated at least 30 days prior to becoming effective. Your continued use of the Service after the effective date constitutes acceptance of the revised Terms.

14. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.
Any disputes arising from these Terms shall first be subject to good-faith negotiation. If unresolved, parties agree to submit to binding arbitration under the American Arbitration Association rules, with proceedings held in San Francisco, California. Class action waivers apply to arbitration.
