1. Acceptance of Terms

By accessing, browsing, or using the IronForge Fitness website, mobile applications, facilities, or services (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Services. These Terms constitute a legally binding agreement between you and IronForge Fitness LLC ("Company", "we", "us", or "our").

2. Membership & Account Registration

To access certain features of our Services, you must register for an account and/or purchase a membership. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain and promptly update your account details.
• Keep your password secure and confidential.
• Be responsible for all activities under your account.

Memberships are issued to the named individual only and are non-transferable. IronForge Fitness reserves the right to verify identity upon facility entry.

3. Fees & Payments

Membership fees are billed monthly or annually according to the plan selected. By subscribing, you authorize us to charge your designated payment method automatically on the renewal date. All fees are non-refundable unless otherwise stated in your membership agreement or required by applicable law. Late payments may incur fees or result in temporary suspension of access until the account is brought current.

4. Facility Usage & Equipment

Members may use our facilities and equipment in accordance with posted rules and guidelines. You agree to:

• Use equipment properly and for its intended purpose.
• Wipe down equipment after use and maintain cleanliness.
• Respect training zones and capacity limits.
• Report damaged equipment or safety hazards immediately.

IronForge Fitness is not responsible for loss, theft, or damage to personal belongings left in lockers, common areas, or vehicles. All belongings are at the owner's sole risk.

5. Health & Safety Disclaimer

Before beginning any fitness program, you should consult with a licensed healthcare provider. IronForge Fitness is not a medical facility and does not provide medical advice. Our trainers and staff are fitness professionals, not physicians or healthcare providers. Any nutritional, workout, or wellness guidance provided is for informational purposes only and does not replace professional medical advice.

6. Code of Conduct

We maintain a safe, respectful, and inclusive environment. Prohibited behaviors include, but are not limited to:

• Harassment, discrimination, or abusive language.
• Intimidation, threats, or physical aggression.
• Theft, vandalism, or unauthorized recording of others.
• Use of illegal substances or intoxication on premises.
• Misuse of equipment or reckless endangerment.

Violation of these standards may result in immediate removal, suspension, or permanent termination of membership without refund.

7. Privacy & Data

Your use of our Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference. We collect and process personal data to manage memberships, process payments, communicate service updates, and improve your experience. You may opt out of marketing communications at any time via account settings or by contacting us directly.

8. Termination & Cancellation

You may cancel your membership according to the terms of your selected plan. Cancellations must be submitted in writing or through your member portal at least 7 days before the next billing cycle. IronForge Fitness reserves the right to terminate or suspend accounts for breach of these Terms, non-payment, or conduct that violates our policies.

9. Limitation of Liability

To the fullest extent permitted by law, IronForge Fitness, its affiliates, employees, contractors, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services, facility access, or participation in fitness activities. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

10. Intellectual Property

All content, branding, logos, training programs, digital materials, and software provided by IronForge Fitness are protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works without express written permission.

11. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles. Any disputes arising from these Terms shall be resolved through binding arbitration in New York City, unless otherwise required by law. Class action waivers and jury trial waivers apply where permitted.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or prominent notice on our website. Continued use of our Services after changes constitutes acceptance of the updated Terms.
