8.1 General Termination Rights
This Section 8 outlines the conditions, procedures, and consequences associated with the termination of your SereneMind account, subscription, or access to our mental health and mindfulness services. Both SereneMind ("Company," "we," or "us") and you ("User," "you," or "your") reserve the right to terminate or suspend access under the circumstances detailed below.
8.2 User-Initiated Termination
You may terminate your SereneMind account or subscription at any time, for any reason, without penalty or obligation. To do so:
- Subscription Cancellation: Navigate to
Account Settings → Billing → Cancel Subscription. Cancellations take effect at the end of your current billing cycle. You will retain full access until that date. - Account Deletion: If you wish to permanently delete your account and all associated personal data, please visit
Account Settings → Privacy → Request Account Deletion. Deletion is irreversible and will remove all progress, journal entries, and mood logs. - Free/Basic Tier: Free accounts may be deactivated at any time via account settings or by simply ceasing use. Re-registration may be required to restore access.
8.3 Company-Initiated Termination
SereneMind reserves the right to suspend or terminate your access to our services, with or without prior notice, under the following circumstances:
- Breach of Agreement: Violation of these Terms of Service, our Acceptable Use Policy, or Community Guidelines.
- Illegal or Harmful Conduct: Using the platform to facilitate, encourage, or engage in unlawful activity, self-harm, harm to others, or fraud.
- Prolonged Inactivity: Accounts dormant for 24+ consecutive months may be archived or deactivated to maintain system integrity.
- Payment Failures: Repeated failed payment attempts for paid tiers may result in temporary suspension until payment is resolved.
- Safety & Clinical Concerns: If we reasonably believe continued access poses a risk to your mental health or safety, we may temporarily suspend access and recommend emergency professional intervention.
Except in cases of immediate safety concerns or severe legal violations, we will provide written notice (via email or in-app notification) detailing the reason for termination and a cure period of 14 days where applicable.
8.4 Effect of Termination
Upon termination, whether initiated by you or SereneMind:
- Cessation of Access: Your right to access SereneMind services, including therapy sessions, meditation libraries, and premium content, will immediately cease.
- Refund Policy: Refunds for prepaid subscriptions are prorated based on unused days, subject to our Refund Policy. Non-refundable promotional or trial periods remain non-refundable.
- Outstanding Obligations: Any unpaid balances due at the time of termination remain payable.
- Emergency Protocols: In the event of company-initiated termination for safety reasons, we will provide resources for local crisis support and licensed mental health professionals where legally permissible.
8.5 Data Handling & Privacy Post-Termination
Your privacy remains our priority after termination. In accordance with our Privacy Policy and applicable data protection laws (including GDPR, CCPA, and HIPAA where applicable):
- Data Retention: We retain anonymized usage data and aggregated analytics for service improvement, provided no personally identifiable information (PII) is linked.
- Data Deletion: Upon account deletion, we will securely erase your personal data within 30 days, except where retention is required by law, clinical record-keeping standards, or active legal proceedings.
- Export Option: Prior to deletion, you may export your mood logs, journal entries, and session history via
Settings → Data & Privacy → Export My Data.
8.6 Survival of Terms
Certain provisions of our Terms of Service shall survive termination, including but not limited to: Intellectual Property Rights, Confidentiality Obligations, Dispute Resolution & Governing Law, Limitation of Liability, and Data Privacy commitments. These clauses remain enforceable indefinitely unless otherwise specified by law.
