04. Intellectual Property Rights

4.1 Content Ownership

All content provided through the Services, including but not limited to films, television series, music, podcasts, images, graphics, logos, icons, text, and software, is the property of StarWave Entertainment or its licensors and is protected by international copyright, trademark, and other intellectual property laws.

4.2 Trademarks

The StarWave logo, service marks, and all related names, logos, product and service names, designs, and slogans are trademarks of StarWave Entertainment. You must not use such marks without the prior written permission of StarWave Entertainment.

4.3 DRM Protection

Our content may be protected by Digital Rights Management (DRM) technologies. Circumventing, disabling, or attempting to circumvent any DRM protection is strictly prohibited and may be subject to criminal and civil penalties.

05. License & Restrictions

StarWave Entertainment grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes, subject to these Terms.

Restrictions

You agree not to:

• Download, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any content unless expressly permitted.
• Use the Services for any unlawful purpose or in violation of any applicable laws.
• Scrape, crawl, or extract data from the Services using automated means without prior authorization.
• Use any robot, spider, or other automatic device, process, or means to access the Services for any purpose, including monitoring or copying any of the material on the Services.
• Record, stream, or broadcast content (e.g., via camera or screen recording software) for distribution or public viewing.

06. User Content

Certain Services may allow you to post, link, store, share, or otherwise make available certain information, text, images, or other material ("User Content").

6.1 Ownership & Rights

You retain any and all of your or your licensors' rights to the User Content you submit. However, by posting User Content, you grant StarWave Entertainment a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content in connection with operating and promoting the Services.

6.2 Responsibility

You are solely responsible for your User Content and the consequences of posting or publishing it. You represent and warrant that your User Content does not violate these Terms or any third-party rights.

07. Live Events & Merchandise

StarWave Entertainment may host or promote live events, including concerts, screenings, and fan festivals. These Terms apply to digital ticketing and registration for such events.

• Ticketing: Tickets purchased through our platform are subject to the terms of the event organizer and third-party ticketing partners. StarWave Entertainment is not responsible for event cancellations, rescheduling, or disputes with third-party vendors.
• Merchandise: Merchandise sold through our Services is subject to availability and may be subject to return/refund policies separate from these Terms.
• Conduct: Attendees must comply with all venue rules, local laws, and event-specific guidelines. StarWave Entertainment reserves the right to deny entry or eject individuals violating conduct policies.

08. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

• Violating any applicable law, regulation, or third-party rights.
• Impersonating any person or entity, or misrepresenting your affiliation with a person or entity.
• Collecting or storing personal data about other users in connection with prohibited activities.
• Interfering with or disrupting the Services or servers or networks connected to the Services.
• Using the Services to engage in fraudulent, deceptive, or harmful activities.
• Posting or transmitting material that is defamatory, obscene, harmful, or infringes upon intellectual property rights.

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND TITLE.

StarWave Entertainment does not warrant that:

• The Services will be uninterrupted, secure, or available at any particular time or location.
• Content will be accurate, complete, or current.
• Any errors or defects will be corrected.
• The Services will meet your requirements or expectations.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STARWAVE ENTERTAINMENT, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

• YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICES;
• ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES;
• ANY CONTENT OBTAINED FROM THE SERVICES; AND
• UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

11. Termination

We may terminate or suspend your account and bar access to the Services immediately, without prior notice or liability, under our sole discretion, for any reason whatsoever and without limitation, including but not limited to a breach of the Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

12. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

13. Governing Law & Jurisdiction

These Terms shall be governed and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the federal or state courts located in Los Angeles, California, and you hereby consent to the jurisdiction and venue of such courts.
