1. Acceptance of Terms
By accessing, browsing, or using the SummitX Adventures website, booking any of our expeditions, or participating in our outdoor activities, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.
These Terms constitute a legally binding agreement between you and SummitX Adventures ("Company", "we", "us", or "our").
2. About SummitX Adventures
SummitX Adventures is a premier outdoor expedition provider specializing in guided trekking, mountaineering, wildlife safaris, water-based adventures, and wilderness camping experiences worldwide. We are not a travel agency, medical provider, or insurance company. Our services are strictly limited to outdoor adventure guiding, itinerary planning, and logistical support as explicitly described in each expedition itinerary.
3. Eligibility & Physical Fitness
To participate in any SummitX adventure, you must:
- Be at least 18 years of age, or accompanied by a legal guardian who assumes full responsibility.
- Meet the specific physical fitness requirements outlined in the expedition details.
- Disclose any pre-existing medical conditions, allergies, or physical limitations during the booking process.
- Provide accurate personal information, including emergency contact details.
SummitX reserves the right to deny participation to any individual whose health, fitness, or conduct we deem unsuitable for the safe completion of an expedition.
4. Risk Acknowledgement & Liability Waiver
⚠️ IMPORTANT: Outdoor adventure activities carry inherent risks, including but not limited to injury, illness, equipment failure, weather changes, wildlife encounters, and remote terrain hazards.
By participating, you voluntarily assume all known and unknown risks associated with outdoor travel and adventure activities. You agree to release, indemnify, and hold harmless SummitX Adventures, its employees, guides, partners, affiliates, and equipment suppliers from any claims, damages, losses, or liabilities arising from your participation, except in cases of gross negligence or willful misconduct directly attributable to SummitX.
We strongly recommend obtaining comprehensive travel insurance that covers emergency medical evacuation, trip cancellation, and adventure sports activities. SummitX is not responsible for uninsured losses.
5. Booking, Payments & Cancellations
- Pricing: All prices are listed in USD and are subject to change without notice. Final pricing will be confirmed at the time of payment.
- Deposit: A non-refundable deposit of 30% is required to secure your spot. Remaining balance is due 60 days prior to departure.
- Cancellation Policy:
- 90+ days before departure: Full refund minus deposit.
- 60–89 days: 50% refund.
- 30–59 days: 25% refund.
- Less than 30 days: No refund. We may offer credit for future trips subject to availability.
- Force Majeure: SummitX is not liable for cancellations or disruptions caused by natural disasters, political instability, pandemics, or other events beyond our reasonable control. In such cases, we will offer rescheduling or partial refunds at our sole discretion.
6. Safety, Conduct & Environmental Responsibility
Participants must strictly adhere to all safety instructions provided by lead guides. Failure to comply may result in immediate removal from the expedition at the participant's expense.
- No alcohol, illegal substances, or reckless behavior is permitted at any time.
- SummitX follows Leave No Trace principles. Participants must respect local cultures, wildlife, and ecosystems.
- Personal gear must meet expedition specifications. SummitX is not responsible for inadequate personal equipment.
- Photography and video recording may be restricted in certain areas for safety or cultural reasons.
7. Intellectual Property
All content on the SummitX website, including text, graphics, logos, icons, photographs, videos, itineraries, and software, is the property of SummitX Adventures or its licensors and is protected by copyright and trademark laws. You are granted a limited, non-exclusive, non-transferable license to access and use this content for personal, non-commercial purposes only. Reproduction, distribution, or commercial use requires prior written consent.
8. Privacy & Data Collection
Your privacy is important to us. Our collection, use, and protection of personal data are governed by our Privacy Policy. By using our services, you consent to the processing of your personal information for booking management, safety communications, emergency response, and service improvement purposes.
9. Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law principles. Any disputes arising from these Terms or your participation in our expeditions shall first be submitted to good-faith mediation. If unresolved, disputes shall be settled by binding arbitration in King County, Washington, in accordance with the rules of the American Arbitration Association. Class action lawsuits and jury trials are waived to the extent permitted by law.
10. Modifications to Terms
SummitX reserves the right to modify, update, or replace these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our website or services after modifications constitutes acceptance of the updated Terms. We encourage you to review this page periodically.
