These Terms of Service ("Terms") govern your access to and use of our website, products, and services, including but not limited to our e-commerce platform, farm tour bookings, wholesale inquiries, and related digital properties. By accessing or using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms.

2 Acceptance of Terms
Your use of the Terroir Cocoa platform constitutes explicit acceptance of these Terms. If you are purchasing on behalf of a business or organization, you represent that you have the authority to bind that entity to these Terms. By proceeding to checkout, booking a tour, or creating an account, you confirm that you are at least 18 years of age and legally capable of entering into a binding agreement.
3 Definitions
- "Company," "We," "Us," or "Our" refers to Terroir Cocoa, a family-owned agricultural enterprise and artisan chocolate producer.
- "User," "You," or "Your" refers to any individual or entity accessing or using our website, services, or purchasing our products.
- "Products" refers to all cacao beans, artisan chocolate bars, gift sets, and related merchandise offered by Terroir Cocoa.
- "Services" refers to our online store, farm tour reservations, wholesale portal, and associated digital platforms.
4 User Accounts
To access certain features such as order tracking, wholesale pricing, or tour reservations, you may be required to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate.
5 Products & Pricing
All product descriptions, including flavor profiles, origin details, and cocoa percentages, are intended to be accurate. However, as our products are artisanal and farm-crafted, slight variations in appearance, weight, or flavor may occur due to natural agricultural processes. We reserve the right to modify product formulations, discontinue items, or adjust pricing at any time without prior notice. All prices are listed in USD and are subject to applicable taxes.
6 Orders & Payments
Orders are subject to availability and confirmation. We reserve the right to refuse or cancel any order for reasons including but not limited to payment verification issues, suspected fraud, or inventory shortages. All payments are processed securely through third-party payment gateways. You authorize us to charge your selected payment method upon order confirmation. Refunds or exchanges for perishable chocolate products are governed by our separate Refund Policy.
7 Shipping & Delivery
Our chocolate products are artisanal and sensitive to temperature. While we pack all orders with appropriate insulation and cooling materials, we cannot guarantee temperature control during transit. Delivery times are estimates and subject to carrier delays. Risk of loss passes to the buyer upon delivery. International shipments may be subject to customs duties, import taxes, and agricultural inspection requirements, which are the sole responsibility of the recipient.
8 Intellectual Property
All content on this website, including text, imagery, logos, design elements, product photography, and farm documentation, is the exclusive property of Terroir Cocoa and protected by copyright, trademark, and intellectual property laws. Unauthorized reproduction, distribution, or commercial use of our content is strictly prohibited. Limited personal or editorial use is permitted with proper attribution.
9 Limitation of Liability
To the maximum extent permitted by applicable law, Terroir Cocoa shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website, services, or products. Our total liability shall not exceed the amount paid by you for the specific product or service giving rise to the claim. You acknowledge that purchasing and consuming our products involves inherent risks related to dietary restrictions and allergies; please review all ingredient labels carefully.
10 Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Ecuador, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms shall be resolved through binding arbitration in Quito, Ecuador, or in the appropriate courts of competent jurisdiction. You agree to waive any right to participate in class action lawsuits against Terroir Cocoa.
11 Changes to Terms
We reserve the right to modify, amend, or update these Terms at any time. Changes will be effective immediately upon posting. Your continued use of our services following the posting of revised Terms constitutes your acceptance of those changes. We encourage you to review this page periodically for updates.
