1. Introduction
Welcome to In Therapy ("Company," "we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of our website, mobile application, and related services (collectively, the "Platform") and the provision of therapeutic services (the "Services").
By accessing, browsing, or using our Platform or Services, you ("User," "Client," or "you") agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Platform or Services.
We reserve the right to modify these Terms at any time. We will notify you of any material changes via email or a prominent notice on our Platform. Your continued use after such changes constitutes acceptance.
2. Definitions
- "Services" refers to the psychological, counseling, and therapy services provided by our licensed professionals, including but not limited to individual therapy, couples counseling, family therapy, and online sessions.
- "Therapist" means any licensed mental health professional affiliated with In Therapy who provides Services to Clients.
- "Platform" includes our website (intherapy.com), mobile applications, patient portals, scheduling systems, and secure messaging tools.
- "Content" refers to all text, graphics, logos, images, audio, video, software, and other materials available on or through the Platform.
3. Eligibility
To use our Services, you must:
- Be at least 18 years of age and have the legal capacity to enter into a binding agreement. Minors may use the Services only with parental or guardian consent and participation.
- Reside in a jurisdiction where our Services are legally offered and where our Therapists are licensed to practice.
- Provide accurate, current, and complete information during registration and throughout your engagement with us.
- Have a suitable private environment for online sessions that ensures confidentiality and minimizes distractions.
4. Description of Services
4.1 Nature of Services
In Therapy connects Clients with licensed mental health professionals for therapeutic support. Our Services may include psychological assessments, talk therapy, cognitive behavioral therapy, mindfulness coaching, and other evidence-based interventions tailored to your needs.
4.2 No Medical Advice
Our Services are for informational and therapeutic support purposes only and do not constitute medical advice, diagnosis, or treatment. In Therapy is not a hospital, emergency service, or crisis intervention center.
4.3 Service Modifications
We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time with reasonable notice. We may update our roster of Therapists, adjust service offerings, or change technical features of the Platform as needed.
4.4 Matching Process
We use a matching algorithm and professional judgment to pair Clients with Therapists based on stated needs, preferences, and availability. We make reasonable efforts to ensure compatibility but cannot guarantee a perfect match in all cases.
5. User Responsibilities
As a Client, you agree to:
- Honesty: Provide truthful information regarding your mental health history, current medications, and treatment goals. Misrepresentation may compromise your care and result in termination of Services.
- Respect: Treat Therapists, staff, and other users with respect. Harassment, abuse, or discriminatory behavior will not be tolerated.
- Safety: Refrain from using the Platform while under the influence of alcohol or drugs, or while operating machinery. Ensure you are in a safe location during online sessions.
- Confidentiality: Maintain the confidentiality of your account credentials and notify us immediately of any unauthorized access.
- Attendance: Attend scheduled sessions or cancel within the timeframe specified in our Cancellation Policy (typically 24 hours in advance) to avoid fees.
- Recording: Do not record, stream, or broadcast sessions without explicit written consent from all parties involved.
6. Privacy & Data Protection
Your privacy is of utmost importance. Our collection, use, and disclosure of your personal and health information are governed by our Privacy Policy, which is incorporated by reference into these Terms.
6.1 HIPAA Compliance
Where applicable, we comply with the Health Insurance Portability and Accountability Act (HIPAA) and other relevant healthcare privacy regulations. We implement administrative, physical, and technical safeguards to protect your Protected Health Information (PHI).
6.2 Data Security
We use industry-standard encryption and security measures to protect your data. However, no method of transmission over the internet is 100% secure. While we strive to protect your information, we cannot guarantee absolute security.
7. Fees, Payments & Insurance
7.1 Service Fees
Fees for Services are displayed on the Platform and/or communicated during the onboarding process. Fees may vary based on service type, Therapist seniority, and session length. We reserve the right to adjust fees with advance notice.
7.2 Payment Methods
Payments are processed securely via third-party payment processors. Accepted methods may include credit/debit cards, Health Savings Accounts (HSAs), and Flexible Spending Accounts (FSAs).
7.3 Insurance
We accept select insurance plans. We will make reasonable efforts to verify your coverage and submit claims on your behalf. However, In Therapy is not responsible for insurance denials, delays, or reductions in benefits. You remain ultimately responsible for any outstanding balances.
7.4 Refunds
Refund requests are evaluated on a case-by-case basis. Refunds may be issued for:
- Technical failures preventing session completion.
- Therapist cancellations made within the no-fee window.
- Duplicate charges or billing errors.
Refunds do not apply to sessions cancelled by the Client outside the no-fee window or to administrative fees.
8. Intellectual Property
All Content, trademarks, logos, and proprietary materials on the Platform are the exclusive property of In Therapy or its licensors. You are granted a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.
You may not reproduce, distribute, modify, create derivative works from, publicly display, or exploit any Content without prior written consent, except as permitted by applicable law (e.g., fair use).
9. Termination
9.1 By Client
You may terminate your use of our Services at any time by contacting support or updating your account settings. Termination does not relieve you of obligations accrued prior to termination.
9.2 By In Therapy
We reserve the right to suspend or terminate your access to the Platform and Services if you breach these Terms, engage in fraudulent activity, pose a risk to safety, or for other legitimate business reasons. In such cases, we will provide notice where legally required and arrange for appropriate transfer of care when clinically appropriate.
9.3 Effect of Termination
Upon termination, your right to access the Platform ceases immediately. We will retain your records as required by law and professional ethics standards, typically for a minimum of 7 years after the last interaction.
10. Limitation of Liability
To the maximum extent permitted by law, In Therapy, its directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
- Your access to or use of (or inability to access or use) the Platform.
- Any conduct or content of any third party on the Platform.
- Unauthorized access, use, or alteration of your transmissions or content.
- Outcomes of therapy sessions, which depend on individual factors and participation.
In no event shall our total liability exceed the amount paid by you to In Therapy in the twelve (12) months preceding the event giving rise to the claim.
11. Dispute Resolution
11.1 Informal Resolution
We encourage you to contact us first to attempt to resolve any dispute informally. Please direct complaints to our compliance team at legal@intherapy.com.
11.2 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or the Services shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. 11.3 Class Action Waiver
You agree that any arbitration shall be conducted on an individual basis only. Class actions, class-wide arbitrations, and representative proceedings are not permitted.
