Frequently Asked Questions

Common legal questions about branding, naming, and startup compliance.

Do I need a trademark before launching my brand? +

While not strictly required to launch, securing a trademark filing (even a pending application) establishes your priority claim and deters copycats. We recommend filing within 30 days of finalizing your brand name to protect your investment.

What's the difference between an LLC and a Corporation? +

An LLC offers flexibility and pass-through taxation, ideal for small to mid-sized businesses. A Corporation (C-Corp or S-Corp) provides stronger liability protection and is better for venture-backed startups planning to issue equity to investors.

How do I protect my domain name from squatters? +

Register your primary domain plus common misspellings and alternative TLDs (.net, .io, .co). Enable WHOIS privacy, set up auto-renewal, and consider registering your brand as a trademark to invoke the UDRP process if needed.

Can I use a trademarked name if I operate in a different industry? +

Possibly, but it's risky. Trademark law considers "likelihood of confusion" across related classes. Even in different industries, strong marks receive broad protection. Always run a comprehensive clearance search before committing.

What legal documents do freelancers/contractors need? +

At minimum: a signed service agreement, IP assignment clause (to ensure you own the work), payment terms, and an NDA if handling confidential data. Our toolkit includes ready-to-customize templates for all of these.
