1. Acceptance of Terms
Welcome to BrightMinds Tutoring. By accessing our website, booking a tutoring session, or using any of our educational services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all provisions herein, please do not use our services. These Terms constitute a legally binding agreement between you and BrightMinds Tutoring, LLC.
2. Description of Services
BrightMinds Tutoring provides personalized academic support, including one-on-one and group tutoring, test preparation, homework assistance, and educational consulting. Services may be delivered in-person, via our secure virtual classroom platform, or through asynchronous communication channels. We reserve the right to modify, suspend, or discontinue any service at any time without prior notice.
3. Registration & Account Security
To access certain features, you must create an account. You represent that you are at least 13 years of age. Users under 18 must have a parent or legal guardian consent to these Terms and manage the account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. Notify us immediately of any unauthorized access.
4. Code of Conduct
You agree to use our services responsibly and respectfully. Prohibited conduct includes:
- Harassing, threatening, or abusing tutors, staff, or other users
- Submitting fraudulent information or plagiarized work
- Recording sessions without explicit written consent
- Using our platform for commercial purposes or unauthorized distribution of materials
Violations may result in immediate termination of services without refund.
5. Scheduling & Cancellations
Sessions must be booked through our platform. You may cancel or reschedule up to 24 hours before the scheduled time at no charge. Cancellations made within 24 hours or no-shows will be charged at the standard session rate. Repeated no-shows may result in account suspension.
6. Payment & Refund Policy
All fees are billed in advance per session or monthly subscription, as selected. Prices are subject to change with 30 days' notice for active subscribers. Refunds are issued only for services not yet rendered. If you cancel a subscription mid-cycle, remaining unused sessions will be prorated. We offer a 100% refund guarantee on your first paid session if you are unsatisfied.
7. Intellectual Property
All course materials, worksheets, videos, platform software, and branding are the exclusive property of BrightMinds Tutoring or our licensed partners. You receive a limited, non-exclusive, non-transferable license to use these materials for personal educational purposes only. Redistribution, copying, or commercial use is strictly prohibited.
8. Privacy & Data Protection
Your privacy is important to us. Data collection and processing are governed by our Privacy Policy. We comply with applicable data protection laws, including COPPA and FERPA where relevant. Educational records and session data are encrypted and accessible only to authorized tutors and account holders.
9. Limitation of Liability
To the fullest extent permitted by law, BrightMinds Tutoring shall not be liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability shall not exceed the amount you have paid us in the preceding twelve months.
10. Dispute Resolution & Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall first be subject to good-faith negotiation. If unresolved, disputes shall be settled through binding arbitration in San Francisco, CA, in accordance with AAA rules. Class action waivers apply.
11. Modifications to Terms
We may update these Terms periodically to reflect service changes, legal requirements, or operational improvements. Material changes will be communicated via email or platform notice. Continued use of our services after such updates constitutes acceptance of the revised Terms.
